The short answer is that a distressed home is much easier to purchase right now than in the past. To understand the basis of my humble opinion, please read on.

Let me begin by stating that the foreclosure process varies from state to state. The basic process comes in two flavors: either judicial foreclosure, or non-judicial foreclosure. The difference is whether the foreclosure process must go through the courts.

Here in Kansas we practice judicial foreclosure, so we have to fuss with the courts to get defaulting home owners out of a Kansas property. Missouri is structured as a non-judicial foreclosure state where the we don't fuss with the courts. Both have their positives and negatives.

Additionally for Buyers, there is a distinction between properties being sold as a result of the foreclosure (a true foreclosure property) and those that have already been through the process and have now been taken back by the mortgage lender after the default (REO or Real Estate Owned properties). If you ask most Kansas City real estate agents, they don't know the difference.

For the Buyer, by far the safer and easier purchase of the two is an REO property. The lender must provide a clear title when selling the property, there can be no liens, it will already be vacant (and usually personal possession free), and all taxes, HOA dues, etc will be paid up to date. A true foreclosure purchase guarantees none of that and the Buyer must exercise a great deal of due diligence.

Short sale vs Foreclosure:
I'm going to assume from this point forward that Buyers are referring to the REO version.

5-7 years ago the banks were faced with the situation with REO's that they now face with short sales. There was a sudden, overwhelming increase in the number of cases and the lenders were simply not capable of handling the sheer volume. There were no systems in place, or those that existed were woefully mismanaged and under resourced. The lenders took a long time to respond, their policies would change, and there was quite a bit of turmoil and general dissatisfaction with all parties involved in those transactions.

Fast forward to about a year ago. Foreclosures have been at near record highs all over the country. The lenders have stabilized their REO departments but still have a huge backlog of defaulting homeowners. People are looking for alternatives to the foreclosure process, trying to prevent default, and salvage their credit scores. Short sales have become "trendy." Short sale applications have swelled practically overnight and the Loss Mitigation departments have begun the nightmarish cycle all over again.

The good news in all of this is that some companies have gotten their policies and procedures in order already and short sale approvals move relatively quickly through their systems. The flip side is that the larger lenders, especially the biggest mergers are suffering catastrophic losses due to poor trained personnel and poorly written policies. Working with an amateur can and most likely cost you thousands. Just contact any real estate attorney in Johnson County and find out how much an amateur actually costs. These are not your garden variety purchases and it takes quite a bit of due diligence, perseverance, and above all clear lines of communication.
