We're often asked what types of
changes in condition should be listed on the Seller's Disclosure....
Slippery roads, poor weather, and a small distraction recently created an opportunity for an Overland Park, Kansas home seller....Last evening a Range Rover slid into the living room of an Overland Park homeowner adding an additional "front entry garage space" to the home! Thank goodness no one was hurt, and minimal property damage, with the exception of the pride of the driver of the Range Rover....
Whether the issue is accidental damage, storm damage to a roof, leakage into your basement, or the occasional Range Rover....Yes, I'm smirking....All of those are examples of material changes in the condition of your home, and all would need to be listed on your
Seller's Disclosure, when you market your home for sale.
While there are a couple of schools of thought, the bottom line is clear; your Seller's Disclosure is a "get out of jail free" card....Why not tell all you know up front? Take the fear out of the process for the Buyer and Buyer's Agent? The thought is that all of the defects you correctly and fully list on your Seller's Disclosure are unlikely to generate any litigation when or if the Buyer may question....
Listing everything you know is the smart idea. Sure, there may be an agent or Buyer that won't make an offer because you list your home with a roof repair of over a year ago...Yet there will be just as many that prefer you are honest with regards to your Disclosure, you are a thoughtful Seller, an ethical Seller, and that you probably maintain your home with regular maintenance and care...and that your home may be worth more than others in your neighborhood.
