The Overland Park, Kansas Police Department announced it will conduct a DUI sobriety checkpoint next week. The checkpoint will be held May 6. The Overland Park police department didn’t release a location of the checkpoints but they did state that the checkpoints are being conducted with the goal of reducing alcohol-related auto crashes and discouraging drunken driving in Overland Park.
Looks like the City of Overland Park cares about its residents. I wonder if other cities in Johnson County will be conducting DUI checkpoints now that graduation parties will be popping up on nearly every street? Having lost a few friends and a couple family members to drunk driving, I applaud cities who are proactive in reducing alcohol-related accidents. How Can EVERY Kansas City Real Estate Agent Be #1??? Dear Dowell Taggart Team;
We get lots of postcards and flyers from Realtors hoping we'll list with them when we're ready to sell our Kansas City home. It seems like EVERY agent is claiming to be #1! What's the deal? -Skeptical Kansas City homeowner
Dear Skeptical, Amazing isn't it? And each of those Kansas City real estate agents is under obligation to be able to support their claims of being #1, but here's the deal....
Numbers can be made to dance the jive if you present them in a way that makes them tell a filtered down "story" the way you want. There's dozens of different ways you can present home sales data.... a time frame, a specific location, style of home, type of home, price range, total volume, total number of sides. Each of these can be a path to #1 claims.
Pick a small enough time frame...Presto! The real estate agent is #1!
Pick a small enough price bracket...BAM!!
You guessed it, the real estate agent is #1 again! Pick a small enough style of home...ranch home split level home, cul-de-sac homes and presto, again the real estate agent is #1 again. Is it number of sales by total dollar value or number or number of transactions?
Two (or more) #1s! What?
Is it number of listings on the market? Number of buyers brought to the area? Number of relocation clients to Kansas City from Wichita, St. Louis or Omaha? The unveiling of the first building on Kansas State University’s Olathe Innovation Campus on Tuesday drew state and local legislators, students, alumni and K-State and Kansas fans alike. Kansas Gov. Sam Brownback, a 1979 K-State graduate and former student body president, was on hand, along with U.S. Rep. Kevin Yoder, who is a KU alumnus and former student body president. Although the two traded jabs at the other’s alma mater, they were in agreement that it was a momentous occasion for K-State, Olathe, Johnson County and the state. “The competition and the collaboration is beautiful. And that’s what we need as a state. We compete, we collaborate,” Brownback said. “There are KU campuses here in Johnson County and K-State campuses here. … We grow, we grow together, we grow competitively, and we can do this as a state.”

According to a Campbell/Inside Mortgage Finance Housing Pulse Tracking Survey, the distressed property index rose to 48.6 percent in March, the highest level the indicator has reached in the past 12 months. Despite the increase in foreclosed homes, some real estate agencies have reported more people are moving, as RE/MAX recently announced home sales increased by double-digits last month. However, that's not the case for everyone, as a real estate agent recently told Campbell Surveys.

There are tentative signs of improvements in the US residential property market as the latest RE/MAX national housing reports shows that home sales increased by double digits in March from a month earlier in nearly all metropolitan areas. Property sales jumped more than 10% in 53 of the 54 metros tracked by RE/MAX between with only New York not achieving double digits gains. In New York, home sales rose 8%. ‘This represents a complete reversal from January, when none of the 54 cities saw even single-digit monthly sales increases,’ RE/MAX said in the report.

Following today’s surprisingly positive National Association of Realtors report on home sales we have more good news to share…an INCREASE in mortgage applications to purchase (vs refi). Clearly, more folks applying for a home loan will result in more home sales. A jump in U.S. mortgage application volume last week was fueled by consumer worries about a scheduled increase in insurance premiums from the Federal Housing Administration, the Mortgage Bankers Association said today.

Despite poor sales in March, homes sales in Kansas are only down 12% for the year compared to last year. This year 1,223 homes have sold and closed year to date. During the same time frame last year, 1393 homes sold and closed.

The National Association of Realtors reported that existing home sales rose 3.7% in March from the previous month. That topped expectations of a 2.5% gain. The NAR said the seasonally adjusted annual sales rate rose to 5.1 million. That’s not a big number — last year, about 4.9 million existing homes were sold — the worst sales rate since 1997.

While the new construction home sales increased 11% the total months supply of new homes has dropped to 7.3 months. The reason for the sales increase maybe the drop on new home prices. New homes prices have dropped 5% in march. Last year the first time home buyer tax credit really stimulated the real estate market. This year despite lower home values and low interest rates, real estate sales are sluggish.
The year to date numbers don’t look much better in Kansas. Homes in pending status are down 29% compared to the same time last year. RE/MAX sells more homes than any other real estate company. For a reason...should we talk?

According to the Heartland MLS listing service, 549 homes sold in Johnson County in the month of March. Thirteen of the homes were condos.
Out of the 549 homes sold in Johnson County, 41 homes were new homes and 494 homes were resale homes including 13 condos.
46 homes were 2 bedroom single family homes, 184 homes were 3 bedroom single family homes and 306 homes were 4+ bedroom single family homes.
The average sales price of the 549 homes sold was $2228,254. The average 2 bedroom home sold for $110,613, the average 3 bedroom home sold for $155,937 and the average 4+ bedroom home sold for $295,042.

Should you do business with InAccurate Title in Overland Park, Kansas?
I wouldn’t and here is why . . .
Last month I had a split closing.
The seller picked their title company, InAccurate Title, and the buyer picked their title company.
During the inspections it was discovered that the roof needed to be replaced. After the inspection negotiations, I prepared an amendment raising the sales price to accommodate the roof, and sent to the buyer’s agent for the buyer’s signature.
Upon receiving the amendment back signed by the buyer, I sent a copy to my office and another copy to the seller’s title company, InAccurate Title.
Next, I sent a new commission statement with the new sales price to the seller’s title company, InAccurate Title.
On the commission statement, the new sales price was very bold. In fact, I added the words “price change” in bold on the subject line. As is traditional, I also requested a copy of the HUD prior to closing. At that time, I also requested a reply that InAccurate Title had received the information.
I sent multiple copies of the new commission statement to InAccurate Title since they hadn’t confirmed they received, still nor response. Later in the day, InAccurate Title finally confirmed they received and noted that they had forwarded to the buyers title company.
Since I had not received a copy of the HUD and InAccurate Title had not returned my phone calls, I assumed that the transaction had not closed early. So I did my normal course of business.
Then the bombshell....On Friday that week, I ran by the vacant property and noticed that there were people living in the home.
I immediately called the buyer’s agent and left a message on her voice mail requesting what was going on. I then called the seller and informed him via a voice mail that we may have a problem. The buyers agent called me back first and informed me that the buyer had closed earlier in the week.
Of course when Monday came around I called InAccurate Title to get a copy of the HUD. When I received a copy, I noticed that the sales price was off a few thousand dollars.
Bottomline, I sat down with my investor/seller/client and reviewed the file. He determined that I did everything possible in his best interest. In fact, my investor/client/seller has switched to my new RE/MAX brokerage.
I asked him that if InAccurate Title doesn't correct their error, will you do business with them?
What do you think he should do?
Traditional solution? There is an “errors clause” in the title work that allows the title company to bring all parties back to the table to re complete the paperwork, and address any issues....Wonder why the Re/Max broker didn’t like that idea? Who knows. Ask him.

New opportunities for research, graduate education and more are coming to the Kansas City area with the opening of Kansas State University's newest campus in Olathe. A ribbon-cutting ceremony at K-State Olathe will be at 1 p.m. Tuesday, April 26, with an open house for the public to follow until 7 p.m.

Building permit reports present a mixed view of first-quarter construction activity in Johnson County. While some of the growth cities showed gains in housing and commercial construction projects, permit totals indicated the opposite was happening elsewhere. Through the first three months of the year, Overland Park and Lenexa registered notable gains in residential construction permit activity while figures dropped in Olathe and Shawnee. The Olathe decline was particularly significant because the city had become the county’s leader in home building in recent years.

Aging Overland Park, Kansas septic tanks are posing a public heath concern and will be a major expense at some point for homeowners. City of Overland Park, Kansas officials have begun discussing the situation and how they might deal with it as the tanks inevitably give out. Leakage from failing tanks would create obvious sanitation concerns that would need to be addressed. But the city is trying to be sensitive to residents who face considerable cost when they need to remedy the problem. Overland Park City Codes Administrator Tim Ryan told members of the City Council’s Community Development Committee that the city has not been enforcing an ordinance that requires septic tank owners to hook to the sanitary sewer system when it becomes available in their neighborhood.

The Olathe City Council unanimously approved tax abatement Tuesday for a new light industrial facility to be constructed in the I-35 Logistics Park, west of Old 56 Highway at 156th Street. The council opened a public hearing to receive comments about the application for $33,372,000 in industrial revenue bonds received from KH Jensen on behalf of Sun Life Assurance of Canada, but no one came forward.

Thanks to a $250,000 federal Homeland Security grant, Overland Park police will obtain the squat iRobot as well as seven other pieces of new equipment that include a surveillance camera system, bomb suit and helmet, and radio and computer gear. The new robot will join one other larger unit that has been on the job for about four years. It, too, came courtesy of a Homeland Security grant.

A new bill introduced in the U.S. House is aimed at improving the process for approving short sales. The bill may soon bring relief to distressed Kansas City home owners who are unable to keep their homes and hope to avoid foreclosure by imposing a deadline of 45 days on lenders to respond to short sale requests.
The legislation, the "Prompt Decision for Qualification for Short Sale Act of 2011," was offered in Congress by U.S. Reps. Tom Rooney (R-Fla.) and Robert Andrews (D-N.J.).
After seeing some short sales take over 18 months to negotiate, this bill should help speed up the process. Many buyers are hesitant to make an offer on a short sale, even a pre-approved one, because of the horror stories they hear. The National Association of REALTORS (NAR) has been actively pushing the lending industry to improve the process for approving short sales, which represent about 13 percent of recent home sales according to NAR data. Many Kansas City REALTORS including us are applauding the writing and presenting of this bill.
"As the leading advocate for home ownership and housing issues, Realtors want to help more home owners avoid foreclosure by facilitating a short sale when a family is absolutely unable to keep their home; however, that can only happen if lenders and servicers approve short sale offers in a reasonable amount of time," said Phipps. "Streamlining short sales transactions will reduce the amount of time it takes to sell the property, improve the likelihood that the transaction will close and reduce the overall number of foreclosures. This benefits sellers, lenders, buyers and the entire community."

The 95th and Antioch Cherokee South shopping center is looking to open a 7,000 SF Johnn's Tavern in August. The restaurant and bar at the southwest corner of 95th Street and Antioch Road will be the ninth metropolitan-area location for the restaurant operator. This area is kind of special for me. There's a new plan to redevelop the old Bannister mall site, but it's going to cost taxpayers $100 million. Developers say they can turn the concrete dessert there into a jobs mecca, but first they need tax incentives before any tenants will sign on the dotted line. On Wednesday, they got the first of many approvals they are going to need, this one from the Tax Increment Financing Commission.
The developer is selling Kansas City a plan that 7400 people will actually work at the old Bannister Mall site. Seriously? Has the developer been out and viewed the concrete jungle and the neighboring community?
