With the announcement last week that the Transportation and Infrastructure Committee approved a bill that would establish an “independent civilian commission” with $65 million in seed funding to start the process of identifying property to be sold and selling it off [1]. Advocates for the bill hope to create $15 billion in savings as a result of these sales, but committee members have noted that this figure is likely “overstated.” The problems with the government selling billions of dollars is first, they don't have an up-to-date inventory list of government owned real estate. Yes, it is surprising, but the government does not have a thorough list of government owned properties. Next, the addition of billions of dollars of more real estate for sale will further hurt the real estate market. With an increase of supply without more real estate buyers, the sales prices will see a plunge. Real Estate Scam of the Day: 13 Banks Accused of Defrauding Veterans, Treasury
The Interest Rate Reduction Refinancing Loans (IRRRL) program was intended to help veterans refinance their home mortgages without having to pay certain fees. However, 13 major lenders now stand accused of using the program to “defraud both our nation’s veterans and the United States Treasury of millions of dollars” through faulty implementation of the program[1]. Two Georgia mortgage brokers blew the whistle on the fraud some time ago but the case was kept under wraps until recently, when it was unsealed. The brokers claim that the lenders instructed them to include additional, prohibited fees like attorneys fees into allowed fees like title examination fees. The court filing states that “defendant lenders over-charged veterans, charged prohibited fees and then deliberately concealed those facts from the VA to obtain taxpayer-backed guarantees for those loans.”Furthermore, the lenders are also accused of submitting a variety of false, fraudulent and fabricated documents to get the loans approved for the U.S. Treasury guarantee[2]. “Tens of thousands of the VA loans have gone into default or resulted in foreclosure,” according to the lawsuit, which also alleges that up to 90 percent of the 1.2 million loans refinanced through IRRRL in the past ten years may have been affected by the fraud. Johnson County Park and Recreation District's Ernie Miller Park will hold a special Halloween-themed event Oct. 8. The Whimsical Woods program is for ages 11 and younger accompanied by a parent or guardian. Participants will enjoy a walk on the park's trail with the award-winning staff of the Ernie Miller Nature Center. Costumed storybook characters will delight and entertain audiences of all ages. In addition, there will be live animals, stories, songs, and surprises. Whimsical Woods will take place from 1 to 4 p.m. Saturday, Oct. 8 at Ernie Miller Park, 909 N. Kansas-7 Highway. As Global Grew, 30-Year Mortgage Rates Drop Have Dropped - Now Mortgage Rates are Below 4%For the first time ever, 30-year fixed-rate mortgage rates have fallen to well below 4 percent, according to a mortgage market survey provided by Freddie Mac.
In the past month mortgage interest rates have continued to set new weekly record lows, but the 30-year mortgages’ latest drop below 4% may be an important threshold for potential home buyers. The 30-year fixed rate mortgage loan is the most popular financing option for home buyers. Mortgage rates are expected to stay below 4% through 2011 before they start rising in 2012. Home buyers taking out loans for home purchases are expected to more than double in the next two years according to a recent Inman News housing report. According to a Freddie Mac chief economist, mortgage interest rates have continued to free-fall as concerns over a global recession grew. Here’s a closer look at rates for the week ending Oct. 6. - 30-year fixed-rate mortgages: averaged 3.94 percent this week, down from last week’s previous record low of 4.01 percent. A year ago at this time, the 30-year fixed-rate mortgage averaged 4.27 percent.
- 15-year fixed-rate mortgages: averaged 3.26 percent, another all-time low. This is the sixth-consecutive week the 15-year mortgage has posted new average record lows. Last week, 15-year rates averaged 3.28 percent. Last year at this time, 15-year rates averaged 3.72 percent.
- 5-year adjustable-rate mortgages: averaged 2.96 percent this week, dropping from last week’s 3.02 percent. A year ago, the 5-year ARM averaged 3.47 percent.
- 1-year ARMs: averaged 2.95 percent, the only mortgage rate to move up last week. Last week, the 1-year ARM averaged 2.83 percent. A year ago, the 1-year ARM averaged 3.40 percent.

When and How to Start a Short Sale in Kansas City - Preventing a Real Estate Foreclosure The professional real estate and banking community has done a horrible job of educating the general public about the short sale process. Many homeowners kind of understand what a short sale is but they do not understand when and how to start the short sale process. Many clients I have worked with contact me very late in the process. Typically after the have received a letter from their mortgage lender. The fact that there is so many REO sales in Kansas is terrible. Many Kansas homeowners do not understand that they have redemption rights after the legal foreclosure sale and that is horrible. There is a lot of misinformation. There are many misconceptions as to why a homeowner would short sale their home. The 9 reasons why a homeowner Should short sale their home versus letting their home go to foreclosure are: 1) A short sale would save a homeowner’s credit. Although there will be a few late pays, that is nothing to having a foreclosure on a credit report. 2) A short sale will save a relationship with the bank versus having a foreclosure. 3) A homeowner will be able to buy a home or automobile much quicker with a short sale versus a foreclosure. 4) A homeowner maybe eligible for a federal loan with a short sale. 5) With the Mortgage Forgiveness Debt Relief and Debt Cancellation Act, a homeowner’s debt in a short sale is forgiven. In a foreclosure, the debt is not forgiven. Many homeowners who go through a foreclosure, find themselves going through a bankruptcy also to stop the creditors. The bankruptcy is a double whammy on the credit report. 6) The homeowner has tax benefits with a short sale versus a foreclosure. 7) Some employers view a foreclosure as not dependable and some employers will not promote their employees. In some cases, some employees have been terminated from their jobs after going through a foreclosure. 8) A homeowner will get better interest rates after a short sale versus a foreclosure. 9) A homeowner who has gone through a short sale will find it easier and less expensive to rent versus going through a foreclosure. 9) A homeowner who has gone through a short sale will have removed the foreclosure stress. . A short sale should be started the second a homeowner realizes they can no longer continue making payments. Waiting even 2 weeks can limit a homeowner’s options. The 14 typical reasons why a mortgage lender would accept a short sale are (There are hundred more reasons, these are the top 14): 1) The homeowner is bankrupting their retirement savings. 2) The mortgage payment on the last adjustment is too high. 3) The homeowner is not eligible for a loan modification. 4) The homeowner received a loan modification, but now it is not working. 5) The homeowner had a job loss. 6) The homeowner had a illness or serious injury. 7) The homeowner is incarcerated. 8) The homeowner had a business failure. 9) The home has suffered significant damage or has a lot of differed maintenance. 10) A death to a homeowner. 11) The party inheriting the property can maintain payments. 12) A divorce to the homeowners. 13) The homeowner has had a job relocation or accepted a new job in a new city. 14) The homeowner has to much debt.
Although a homeowner can start the process at any point up until the day of the Foreclosure auction, obviously, the sooner the better. If the homeowner intends to have a successful short sale, start contacting a short sale specialist immediately. It takes time to properly prepare a successful short sale. . Many home owners try to time things perfectly in the short sale process. The homeowner wants to sell their home, rent down the street, and move in over the weekend. That’s a perfect world, and unfortunately short sales are far from perfect. Once a homeowner’s home goes under contract, which can be up to a year, it takes another 2 to 6 months to negotiate the short sale. Then another 30 to 60 days to close. The process can easily take 6 months to a year. Things aren’t perfect and it takes time. So Why rent? Why should a homeowner go out an rent a home to early. Look at the positive side. If the mortgage lender wants to take months to negotiate the short sale, why go out an rent a home to early. Checkout rental options but don't rent a place yet. Save the money that would be normally used for rent. Again the process can take months, so why go out an rent a home to early. If there is any advice that should be directed toward a homeowner it is on timing. The homeowner should forget about the way they want the timing to work out. It won’t work that way….it almost never does. Instead of trying to perfectly time everything, start the short sale process sooner by contacting a short sale specialist than later, then start planning the next move. It takes time. If the financials don’t show this, the mortgage lender may deny the short sale request.3) Optimistic Home Value - The mortgage lender hires an appraiser to determine the home value. If the appraiser submits an appraisal that is to high, the mortgage lender may counter the offer submitted or deny the request for a short sale.4) Deferred Maintenance - If the Kansas City homeowner has been having problems paying the mortgage, they may have also neglected repair issues around the home. If the repair issues are costly, the mortgage lender may decide to deny the request for a short sale. They may decide to foreclose the Kansas City home and make the necessary repairs then sell the Kansas City home as a REO property.5) Deny the Appraiser - The mortgage lender will send an appraiser to the Kansas City home to help determine the value. If the Kansas City homeowner denies the appraiser from entering the home, the mortgage lender may deny the request for a short sale.6) Not Enough Time - The mortgage lender may deny the request for a short sale if there is not sufficient time allowed to process the short sale in the real estate contract. 7) Sales Contract Not Complete - The mortgage lender will review the sales contract. If the sales contract is not completed correctly with the proper addendums, the mortgage lender may deny the request for a short sale.8) Incomplete HUD/Settlement Statement - When the real estate contract is submitted, the mortgage lender will want to review a HUD/Settlement statement. If the HUD settlement statement is missing or incomplete, the mortgage lender may deny the request for a short sale.9) Not an Arms Length Transaction - If the offer submitted is from a family member or friend, the mortgage lender may deny the request for a short sale. The mortgage lender wants a sales contract from a non-relative. They also don’t want to review a sales contract that has the homeowner planning on renting the home.10) Not Completing Paperwork in a Timely Matter - The paperwork needs to be completed in a timely matter. If the homeowner does not submit the paperwork in a timely matter, the mortgage lender may deny the request for a short sale.11) Timing - The mortgage lender may deny the request for a short sale if the foreclosure date has already been scheduled.12) Homeowner Filed Bankruptcy - If the Kansas City homeowner filed bankruptcy, the mortgage lender may deny the request for a short sale.13) Low Ball Offer - The mortgage lender may deny the request for a short sale if the initial review of the sales contract reveals that the sales price is to low.14) Inspections - The mortgage lender may deny the request for a short sale if the inspections have not been completed within 15 days of the acceptance of the sales contract. Most buyers want to wait until the offer has been accepted by the mortgage lender. Mortgage lenders want ALL contingencies completed. In addition, the negotiator assigned by the mortgage lender maybe thinking that if the buyer is concerned about $400-$500, then they may not be the most qualified buyer for the Kansas City home. 15) Cancellation - The mortgage lender may deny the request for a short sale if the buyer has canceled the sales contract prior to the mortgage lenders approval.16) Unrealistic Closing Date - The mortgage lender may deny the request for a short sale if the closing date is to quick. For a pre-approved short sale, the mortgage lender is looking 30-45 days to close. For a short sale that has not been pre-approved, the mortgage lender is looking for closing dates to be 60-90 days.17) Deny Banks Acceptance - Once the mortgage lender makes an offer, they will expect the Kansas City homeowner to accept the terms. If the terms are not accepted in a timely matter, the mortgage lender will deny the short sale.18) Additional Liens - The mortgage lender may deny the short sale if there are additional liens. The additional liens may affect the ability to close the sales contract.19) Uncooperative 2nd Mortgage - The 2nd mortgage lender typically gets pennies on the dollar to nothing. Because of this they may become uncooperative. If the 2nd mortgage becomes uncooperative, the mortgage lender may deny the short sale.20) AS-IS - The mortgage lender and Kansas City homeowner will not be paying for repairs. The mortgage lender may deny the short sale if there is a request for repairs.21) Complicated Contract - The mortgage lender may deny the short sale if the sales contract is complicated with additional addendums and amendments. Mortgage lenders like to see clean simple contracts.22) Fraudulent Request - The mortgage lender may deny the short sale if they believe the financials submitted or additional paperwork has been fraudulently submitted.23) Not a Strong Buyer - The mortgage lender may deny the short sale if they believe the buyer is not qualified or a strong enough buyer to purchase the home. The mortgage lender will not start working on the file if the buyer does not appear strong enough to buy the home.24) Inaccurate Appraisal or Broker Price Opinion (BPO) - The mortgage lender may deny the short sale if the appraisal and/or BPO ordered by the mortgage lender does not support the value on the real estate contract. Typically this means that the analysis is much higher than the sales price.25) Insufficient Hardship - The mortgage lender may deny the short sale if the homeowner has not shown a valid hardship.26) Incompetent or No Short Sale Agent - The mortgage lender may deny the short sale if there is no short sale agent or the short sale agent has demonstrated an inability to handle the short sale for the homeowner. 27) Short Sale Addendum Missing - The mortgage lender may deny the short sale if a short sale addendum that clearly states that the real estate offer is contingent upon the mortgage lenders is missing from the real estate contract.28) Unqualified Homeowner - The mortgage lender may deny the short sale if the lender does not think the seller is qualified for the short sale. Reasons for being unqualified are not behind on mortgage payments or haven’t shown an “imminent danger of foreclosure”.29) Unlawful Request - The mortgage lender may deny the short sale if they make a demand that breaks state law. Banks are governed by Federal law and believe they are not subject to state law. Many times they will make demands that are against state law. Most of these demands are directed toward title interest of the property. 30) Information Does Not Match - The mortgage lender may deny the short sale if the information on the request does not match the information on their files. The address and mortgage holders name(s) need to match exactly what is on file with the mortgage lender.31) Bad Behavior - The mortgage lender may deny the short sale if the short sale specialist who is working on behalf of the mortgage holder exhibits bad behavior. Although it is understandable why a short sale specialist may get upset on the phone when they’re asked to send a document for the tenth time or receiving no follow-up for 6 months, the short sale specialist must stay calm on the phone with the mortgage lender.If you have been denied a short sale and you think the mortgage lender is wrong or maybe in error, request a review or an appeal. It has been over 4 years since Amanda Knox that was first convicted in Italy. On her appeal, Amanda has been acquitted. Amanda will be released from prison immediately.

The Idaho Innocence Project, a non-profit legal organisation dedicated to proving the innocence of wrongly convicted people through the use of DNA testing, worked on the Knox and Sollecito case. This past may, Dr Gregory Hampikian, director of the project, announced that, based on its independent investigation and review, Knox and Sollecito are innocent of the crime. Hampikian stated that more than 100 DNA samples taken at the crime scene pointed to Guede, and excluded Knox and Sollecito. Hampikian is a volunteer consultant for the Knox defense. In Italy, there is no double jeopardy. Many think that the prosecutor will file new charges.
