Question: I am purchasing a single family foreclosure home in Kansas City that is bank owned. According to neighbors, the home that has been vacant for a year and a half. The bank accepted my offer and I submitted an earnest check in early November, 2011. A clear title seems to be the delay. My question is do banks put homes on market without clearing liens and loans?– Stan K. from Overland Park, Kansas Answer: Stan, I hope you're working with a real estate agent. If not, your real estate purchase could get tricky. Yes, it is common for banks to put homes on the market before they have clear title. In addition, it is not uncommon for liens to pop up on the home after the foreclosure process. Once the contract was accepted, the contract was probably sent to a title company to start the title process. As a real estate agent, I have typically have a title company pull a title commitment the first week.Also typically before closing, I will get a call from the title company that a lien as just been issued on the foreclosed home. The liens can be tax liens, home association liens or a mechanic liens. In addition, sometimes, the title was not cleaned up when the home was foreclosed on by the bank and the title company may have missed the liens. On a foreclosure home, the liens should be cleared up fairly fast. If they are not, as in your case, I would suggest contacting the title company directly and ask them why there is a delay in closing. Maybe paying off a small lien can solve the problem. Active = Property for sale, a home buyer can still make an offer to buy the property.
Pending = Property still technically for sale; however, the homeowner has accepted an offer. A transaction stays “pending” until the buyer actually closes on the property.
Backup = Although the homeowner has accepted an offer on the home, they will accept a backup offer. Homeowners usually do this when they have a belief that the contract may cancel. Many times short sales are placed on a Backup status until the lender accepts the terms of the contract.

Question: My Chapter 13 has been discharged for six months and I have a 704 credit score (avg.) with a debt to income ratio of 28%. As such, can I qualify for a Mortgage to buy a home in Kansas City? Kansas City Real Estate New Home Sales Stats - New Home Sales Continue Upward Trend in Sales
New home sales in Kansas City has continued with its upward tick. Although new home sales are still lower than the past summer, new home sales have continued their upward swing. In October there were 128 new homes sold. November new homes increased by 8 homes sold to 126 homes. December new homes increased another 11 homes sold to 147.

Question: My husband and I are considering on making a cash offer on a foreclosure property in Olathe, Kansas. We're assuming that we'll need to prove that we have the cash to close. The problem is we don't want to provide a bank statement prior when we make the offer because we have much more in our account than what is required to buy the home. We're afraid that if the bank sees the amount we have in our account it will hurt our negotiating.
