Question: I have my home listed and the REALTOR has found a buyer. My contract is past inspections and is scheduled to close in 2 weeks. The problem is a buyer came to my door and has offered to buy my home for more money. How can I get rid of the contract and my REALTOR so I can pursue the higher offer?John F. from Olathe, Kansas Answer: First, it will cost you some money, but I would contact an attorney. Since you are past the buyers inspections and are set to close, an attorney maybe your only way out. In the end, you may not have gained much for going after the higher offer. And who knows if the higher offer buyer will actually close. You run the risk of being sued by the buyer, buyer's agent and your listing agent so I hope the 2nd offer is significant. Question: I bought a home in Gardner, Kansas last fall. This past week I turned the air conditioner on and it blew out hot air. What should I do? Pam D. from Gardner, Kansas Answer: Pam, I get this question nearly every spring. I would first review your real estate contract. If there is a home warranty, I would contact the home warranty company. If there is no home warranty, I would first review the sellers disclosure and review what the seller disclosed. I would then contact the home inspector and discuss the malfunctioning air conditioner with the inspector. The inspector may recommend having a qualified HVAC repair person inspect your air conditioner. I recommend setting up your furnace and air conditioner on a routine yearly service maintenance checkup. Question: I interviewed four Kansas City REALTORS to sell my house. The recommended selling price from these REALTORS varied by $40,000 for a house we paid $220,000 for 5 years ago. How do I determine what my house should really be listed for or is worth? How do I determine if the REALTORS are inflating the listing price to obtain my business? –Cathy D. from Overland Park, KansasAnswer: You seem like a very wise seller and I appreciate your question. As a 23 year real estate veteran, my experience is that over 50% of the home sellers choose their REALTOR based on what the REALTOR says they can sell their home for. Last year, I was in competition with two other REALTORS in getting a listing. The seller decided to list with the REALTOR who suggested the highest list price. Six months later I received a call from the seller requesting another presentation because their home was expiring with the first REALTOR. I lost the second time to a family friend who was a REALTOR and who suggested that they could sell the home for a higher price. Here in March, the seller called me again to list their home. It apparently didn't sell with the second REALTOR. Choosing a REALTOR because they picked the highest list price is a bad idea.
If the REALTOR'S price vary that much I would look at the sales data again and do an average of those prices eliminating the highest and the lowest numbers. Then look at that number, and use that as your basis or asking price. Selling homes is not like selling Polo shirts. Home buyers will not pay more for a home because who is marketing it to them.
Choose a REALTOR based on experience and professionalism and has the stats to back up their stats. The one that you should go with is that one, coupled with your comfort level with that person’s expertise in your marketplace.
If you cannot come to a conclusion from this then use the highest estimate and make an adjustment within two weeks or more time if needed depending on your markets activity level to bring it within the best and optimal asking price. Be careful though. If you list to high, there is a good chance you will actually sell for more a much lower sales price than listing correctly at the beginning.

Question: I was recently contacted by mail from the Litigation Law Group out of California offering to reduce my house payment and lock in a low interest rate. I am currently not behind on my mortgage. I called them and after answering a few questions about our finances a representative called me back in less than an hour and said they could knock my house payment nearly in half. He also added that he could do this because he was knocking my mortgage interest rate to below a 2% interest rate. All he needed was $2995 upfront to get started. It sounded great to my wife and I but what made us hesitate is that he wanted the money and other documents within 48 hours. If we waited we would not get such a great deal. It is called the Homeowner and Stability Program. You must agree to the terms in the signed contract unless it is amendable. Real estate contracts are not amendable by only one party. Both or all parties need to agree to changes in writing. It’s important to remember that one of the primary reasons that you are hiring a Realtor is for their knowledge of the process and guidance to the settlement table. Prior to the home going into the MLS, your REALTOR has helped established a list price, helped prepare your home for sale and started the marketing. Your Realtor shouldn’t be faulted for not bringing a Buyer within the first 30 seconds of you deciding to sell your house. Are you certain this is the best possible offer? Remember that the terms are just important as the sales price. Have you verified the Buyer’s pre-qualifications? Is the buyer really qualified? What if there is a defect with the title? What if the inspections turn up a big issue? Are you comfortable with handling all of these hiccups? It is rarely in your best interest for your listing real estate agent to bring in their own Buyer. They will no longer be able to look out for your best interests. I’ve often told my home seller that getting the home buyer's offer is the easy part these days. Question: I recently submitted an offer on an REO property in Olathe with an expiration so we could hear back quickly and avoid a “highest & best offer” situation due to multiple offers. Come to find out, the listing agent that received the offer from my real estate agent didn’t submit the offer before the expiration because he wanted to wait until more offers came in and present them all to the bank. Answer: Welcome to my world, Julie. REO and short sale contracts are not handled the same as normal real estate contracts. Typically while you still have deadlines, the banks are not required (and couldn’t care less) about meeting any deadlines you try to put on them. Trying to gain an edge to present an offer that is unacceptable to the bank will not work. The listing agent has had communication with the bank and has an idea of what the bank will accept. The listing agent will typically wait until an acceptable offer is presented.

Question: I just inherited a house in Overland Park which I intend to sell immediately. If I advertise & sell it “As-Is”, with no property disclosures, does the home buyer have any recourse against me or can they cancel the contract for defects discovered in an inspection?–Kelly W. from Leawood, Kansas
Answer: Yes, home buyers can cancel the contract during the due diligence period (Inspection Period). The inspection period is typically the first 7-15 days of the contract period. Selling “As-Is” means that you won’t be responsible for fixing anything, but Buyers have the right to know what they are buying ahead of time. You also have a duty to disclose any known defects in the home and the Buyer “could” have recourse if you knew of something and didn’t disclose it.
Your best bet is to be upfront with Buyers but of course, if you never lived there, discuss proper wording on the contract with your attorney to cover yourself for any later problems. Question: I'm selling my home in Olathe, Kansas and have a question about my decor. My decor is wine red in color. I have rooms that are wine red, counter tops that are wine red and window curtains that have wine red in them. Everything I’ve read and been told is that you don’t want to have a room that is a bright bold color. . Weekly, I receive depressing emails from Kansas City homeowners who have never wondered why they should do a short sale versus having their Kansas City home foreclosed on. Many of these homeowners write with great emotions, frustration and and irritation about how their banks have messed around with them for months and still never grant their loan modification. They will write about the over promises, idiotic demands and repetitive steps in getting their loan modification granted. Although every story is different, the theme is the same. The mortgage bank lost my documents, skipped my file, gave conflicting updates by multiple representatives, or gave misleading progress reports. In the end, the homeowners received a foreclosure notice rather than the loan modification acceptance letter. By this time there is very little time to work out a short sale. Some homeowners say the banks lied to them, tricked them into going into default, refused to give them documentation that verified any verbal agreements, and then left them up a creek without a paddle. For these people, a short sale might be the answer. It's not the answer that results in homeowners keeping their homes, but it is better than a foreclosure. Most clients who we help with a short sale, wished that they would have started the short sale process much sooner. Most homeowner don't know that there is not cost and in many cases the mortgage lender will offer relocation assistance. Question: I offered $225,000 for a short sale property in Overland Park, Kansas with 10% down. The seller countered that buyer must be willing to put 20% down if the lender requires. I accepted the counter, hoping 20% will not be needed and escrow has been opened. The sellers lender has responded that they want 20% down on this property due to poor condition. I do not have that much cash. Please get back to me asap. Can I get out of this contract? –Nygen from Overland Park, Kansas
Answer: If you agreed to buy the Overland Park home with 20% down, then you cannot get out of the contract for the reason “my lenders wants 20% down”.
However, if you are in your “contingency period”, which is usually 10 days from the acceptance date, you have other ways out of the contract.
For example, during your contingency period, you can get out of the contract without losing your deposit if: - You get a home inspection and don’t like what you find (this inspection typically runs anywhere from $250-400), or you get a pest inspection and don’t like what you find (this is usually the cheapest inspection to get at about $75), - You read the Natural Hazard Disclosures and don’t like what you find (this is paid for by the sellers).
Your contract outlines these details and your real estate agent should be happy to explain it to you. Frankly, your real estate agent should have instructed you NOT to accept the counter offer in the first place, since you were not truly willing/able to put 20% down. It’s too late now, but in the future, do not sign agreements that do not 100% meet your needs.
If you've past the contingency period, I would suggest contacting a real estate attorney, if you still want out of the real estate contract. An attorney maybe able to negotiate keeping the down payment at 10% if your lender can approve the mortgage loan with 10% down.

Q: There is a house I am pursuing that is about to be foreclosed on in Olathe, Kansas. Johnson County has assessed the property at $172,000, but is on the market for $210,000. What would be a good bottom dollar number for a short sale offer on this house in Olathe? I know the bank doesn’t want to foreclose on it because of all the fees included in it. A: You are certainly correct about the bank not wanting to foreclose on the property…they will recover much less of their investment should the property go to auction. However, it is somewhat misleading to base the actual value of the property on the tax assessment as those are notoriously off. The tax assessment is not a true value of the property. You would want to compare the home you are pursuing to other homes in the subdivision that have sold. This will help in determining the value of the home. Additionally it’s important to determine how many lien holders (lenders) the property has. While the primary lien holder may be willing to close for x amount, it may mean the secondary lien holder is left out and they and they may refuse to negotiate. When making an offer on the short sale, you will want to find out who the lien holders are, and who the investors are (FHA, VA, FREDDIE, etc) and if the mortgage liens are portfolio liens or investor loans because that will play a huge role in what your “bottom dollar” offer will look like, while still getting the offer accepted. Last fall I bought a home in Overland Park. I found out that I bought a "Money Pit", What can I do? Question: Last fall I bought a home in Overland Park. I did not move in right after closing because I had to sell my home I was living in. During the negotiations of our home I reviewed the sellers disclosure and even discussed it with my inspector while he was inspecting the home. The inspector noted a few issues, but overall I was happy with the home. Once I moved into my new home, I found out that I bought a "Money Pit." I have found out from neighbors and contractors that the seller knew of major problems in the home, but have never disclosed. We even found out that a rabid bat killed the previous families dog. Question: As a first time home buyer I was excited to being able to buy my first home. I made an offer on an Olathe foreclosure home last December. In January my offer was accepted by the bank and so my real estate agent recommended that we complete our inspections. My agent sent me a signed contract with a stamp from the bank in the sellers section. I completed my inspection and I was ok with the outcome. I have been on cruise control until last Friday, a week before closing. I was notified by my real estate agent that the bank has denied the purchase. When I asked why, I found out that the bank has thrown out my offer and has accepted a cash offer. How can the bank throw out my offer and accept another offer on the home I was purchasing in Olathe? Also, what about my inspection and appraisal fees? I found out that the cash buyer is using my appraisal and inspection. This burns me up. I would take your contract to an attorney to have it reviewed. I know some banks use specific addendums that allows them to cancel the real estate contract any time and without penalty. Question: As first time home buyers, my husband and I were excited to make an offer on a foreclosure home in Gardner, Kansas. Everything seemed to be going great until we got to the inspection. There were lots of little and major things uncovered on the inspection. What burns us up is that the listing agent knew of the problems when we made the offer from a previous inspection on the home and never disclosed this to our buyers agent or us. Since we have little money, if we back out, which we will probably do since we were buying the home "As-Is", we will probably not be able to buy a home for another year. We will lose over $1000 because the listing agent didn't disclose known defects. Banks don't think they have to play by the same rules and laws as everyone else. This is extremely common. That is why real estate agents recommend ALL inspection possible when buying a foreclosure home. It is at the buyers mercy to investigate the problems in the home. If a buyer doesn't feel it is in their scope of work, they can always backout of the contract. Another option for home buyers buying foreclosure homes is to get a FHA Rehab loan like a 203K.
