    Answer: As a real estate agent, I get asked this question quite frequently. First, if you offer a decorating allowance, buyers will still not see past the decor choices. I recommend using neutral color choices on your home. Specialized colors and decor choices will cut down on the number of buyers, even if you're offering a decorators allowance. Buyers can't see past what they see. I would recommend having a staging expert view your home and have them recommend specific options for you.

I wanted to sell my home in Olathe, Kansas because I am recently divorced and making the monthly mortgage payments is a little stretch. I wanted to buy a smaller home in Olathe, but I haven’t found anything I like or will cheap enough to lower my monthly payment. It doesn't make sense to me to move to a smaller home and pay the same monthly payment. What would happen if I got out of the contract? Would I owe the Realtor anything? Should I look at refinancing as an option to lower my current mortgage?

    AnswerThere is a reason the paperwork you signed is called a contract. A contract is an agreement by two  parties that have their understanding down in writing, signed their names and are bound by it. Unless there is a provision in the agreement that lets you back out, then I don't see an easy way to get out. I would first meet with your REALTOR and discuss with them your situation and see what they recommend. If I were your agent, I would hope that you would come to me with all of these questions and let me guide you to the right result for you. As an exclusive buyer’s agent, I feel that is my job.

    Answer: Good luck on your relocation. I would first try selling your Olathe home, before trying to renting it out. Renters will typically never take care of your home like yourself and moving outside the area will make it difficult to take care of. In addition, you will typically not sell your home for "Top Dollar" after having a renter.

    When obtaining a mortgage in your new area, a mortgage company will count your rental property has a debt because they will only count 75% of the rental income as income. This is because the mortgage payment minus the 75% of the monthly rental payment is usually a negative rental income.

    I had a homeowner who rejected an offer on his home for $285,000. He decided to rent for a year. This homeowner figured when he re-listed he could sell for over $300,000 because the real estate market improved. When he decided to sell again, he ended up selling his rental home for $263,000. That is $37,000 less than what he figured he would get.
    If you're not successful in selling your home for at least 3 months, I would then maybe look into renting your home.

    Answer: Yes, it is legal for an Olathe, Kansas real estate agent to buy property but they are required to disclose in writing that they're a real estate agent in the State of Kansas. Typically this is done by adding the verbiage "The buyer is a licensed real estate agent in the State of Kansas" in the real estate purchase contract.

  • My real estate agent brought an written offer to purchase my home in Olathe - I'm not sure I have a sales contract

    Question: My real estate agent brought an written offer to purchase my home in Olathe. Instead of signing, I made a written counter offer. According to my real estate agent, the buyer made a verbal counter. I agreed to the buyer's counter, verbally. My real estate agent told me the buyer had signed the offer. When I asked the agent if I needed to sign the agreement she told me that I had already signed the counter-offer. I never signed the counter-offer agreement with the terms we verbally discussed. I want to make sure that an error does not delay the sale or we proceed to closing with the wrong terms. What should I do and do you thing I really have a contract?

    Answer: Annie, from what you described it does sound like you may have an agreed upon sales contract. Since only written contracts are enforceable in Kansas, make sure all parts of the sales contract is in writing. It is common to negotiate real estate contracts verbally, then follow-up in writing.

    Since you are entitled to receive all copies of every document, I would first request a copy of the entire contract in writing. After receiving the contract, look at the counter offer. Review the counter for the terms you agreed to verbally. Also review your signature and the buyer’s signature/dates.

    I would also request a copy of a estimated sellers proceeds statement from your real estate agent and the title company.
