Question: We made an offer to purchase a luxury home in Kansas City. Everything seemed to be proceeding well until a day before our inspections. We found out through the tenant that they are suing the owner of the property due to unsafe living conditions because of mold. Now the listing real estate agent wants us to sign a release for the mold (small amount in the laundry room) and the current lawsuit. The lawsuit was never disclosed to us when we made the offer to purchase.
My concern is if the tenant wins the lawsuit and the homeowner has no assets, will anything come back to us, the new homeowners? How do I find out if the house has a lien against it? Can the court award the tenant the house even if we have bought it from the owner being sued? –Francis H. from Kansas City
Answer: This sounds like a complicated manner and more information is needed to help you. I am going to recommend you speak to an attorney, immediately. In addition, the title company should be able to tell you if there is a lien or lis pendins recorded against the property you have made an offer on.
If there is not something recorded that does not mean everything is in the clear, that is why I recommend you speak to an attorney to evaluate your risks.
An important manner is you should have a mold expert evaluate the mold issue in the home. There maybe more mold that has been covered up or in an inaccessible area. Former Citigroup CEO Sanford "Sandy" Weill sold–for the full asking price– his opulent New York City penthouse with a glass shattering $88,000,000 price tag to a young college student. Sandy promises to donate the proceeds to unspecified philanthropic causes. The first reports out of the New York Observer on Sunday pinned the penthouse purchased atop limestone sheathed 15 Central Park West to a Russian chemist turned multi-billionaire potash potentate Dmitry Rybolovlev. Dmitry sold his fertilizer last year for around $6,500,000,000 and is said to be worth somewhere in the neighborhood of 9.5 billion bucks.The folks at Forbes quickly followed up with an important (and flabbergasting) clarification: The Sandy Weill spread, 6,744 square feet of immaculate interior space with a wide terrace that wraps around three sides of the apartment with drop dead park and city views, was not actually purchased by Mister Rybolovlev but rather his 22-year old second daughter, Ekaterina Rybolovleva. Ekaternia is a horse-minded U.S. college student and also competitive equestrian.Forbes actually received a statement from young Miss Rybolovleva's representative(s) who revealed the barely legal heiress "plans to stay in the apartment when visiting New York." What? "When visiting New York." This college student just dropped a record breaking $88,000,000 on a second home. Didn't another kid record the 2nd largest real estate purchase in the U.S.? Yep, that is right. The Candy Spelling mansion in California was purchased by a 22-year old London-based Formula One racing heiress, Petra Ecclestone. What is the deal with these kids paying so much for 2nd homes? If you haven't heard, the attorney general of Massachusetts, is taking to court 5 mortgage companies for possible foreclosure fraud. In an effort to stop the harassing phone calls and properly foreclose on homeowners, Bank of America has organized a good-intentioned event:
Bank of America plans to meet in mortgage holders in Boston, face to face, in person, to go over how the mortgage-payment pressures can be eased.

“The purpose of this event is to eliminate the faxes, the FedEx mailings and the phone calls to 800 numbers and allow for face-to-face interaction with a home-loan specialist,” a Bank of America spokesman says.
Walk-in mortgage holder participants are welcomed, but Bank of America would appreciate it if mortgage holders could make advance appointments by phone or the Internet in an effort to guarantee a face to face appointment. Seriously, like mortgage holders will get a hold of a Bank of America representative the first try to setup an appointment. I bet it will take repeated tries.
So to avoid infuriating phone calls and other forms of non-human interaction, mortgage holders have to make repeated infuriating phone calls to Bank of America or some other form of communication.

Home Prices Continue to Fall - Exclude Distressed Sales and Kansas Homes are AppreciatingAccording to the CoreLogic Home Price Index (HPI), national homeprices, including distressed sales, also declined by 3.9% on ayear-over-year basis in October 2011 compared to October 2010. This follows a decline of 3.8% in September 2011 compared toSeptember 2010. Excluding distressed sales, year-over-yearprices declined by 0.5% in October 2011 compared to October 2010and by 2.1% in September 2011 compared to September 2010. Distressed sales include short sales and real estate owned (REO)transactions. Kansas Foreclosure Laws - How to Stop a Kansas Foreclosure - What is a Short Sale?
Kansas is a judicial foreclosure mortgage state with no non-judicial foreclosures available. All foreclosures in Kansas are processed through the courts. The foreclosure sale for Kansas properties held at the courthouse steps around 130 days into the proceedings. A Kansas homeowner has typically 90 days from the sale date to redeem the sale at the sheriffs office.
The best way to prevent a Kansas from foreclosure is to short sale it prior to the sale date.

According to the Kansas City Heartland MLS, pending contracts in Kansas for the month of March were down 333 or -36% of the same month in 2010. Last year the first time home buyer tax credit really stimulated the real estate market. This year despite lower home values and low interest rates, real estate sales are sluggish.
The year to date numbers don’t look much better in Kansas. Homes in pending status are down 29% compared to the same time last year. RE/MAX sells more homes than any other real estate company. For a reason...should we talk?

According to the Heartland MLS listing service, 549 homes sold in Johnson County in the month of March. Thirteen of the homes were condos.
Out of the 549 homes sold in Johnson County, 41 homes were new homes and 494 homes were resale homes including 13 condos.
46 homes were 2 bedroom single family homes, 184 homes were 3 bedroom single family homes and 306 homes were 4+ bedroom single family homes.
The average sales price of the 549 homes sold was $2228,254. The average 2 bedroom home sold for $110,613, the average 3 bedroom home sold for $155,937 and the average 4+ bedroom home sold for $295,042.

Want the bad news now?
Most Sellers that believe their home shows better than their neighbor’s home are wrong. Sorry, not true most of the time. Your home may simply show different deficiencies.
Buyer and I are waiting outside a Leawood home, I haven’t previewed this one, and the wife is on the way. He says, “Let’s head in and wait inside.” Famous first, and last words....
He says, “Martin I was expecting to see a dead body somewhere. Check out the pantry in the kitchen....Roaches. Ugh.”
This isn’t an episode of CSI Miami. These were first impressions of Leawood, Overland Park, and Olathe Kansas homes.
So you believe you’re home is prepared to show, prepared to make the best first impression....prepared to sell. You have 37 seconds to make a good impression. What kind of impression is YOUR home making?
Better idea; let’s go look at the competitive homes, look at them with an honest eye toward condition, maintenance, and decor....general cleanliness.
Fast forward to an Overland Park home. "Victoria was scared to go pass the entry hall." “You should have seen the look on my Larry’s children's faces. Priceless!”
Just a few of the remarks Chris and I have heard over the past few weeks. Seriously, we walk into homes with qualified Buyers. Home Buyers with money, a desire to purchase....And these are homes that appear to have little structurally wrong, and are located in good neighborhoods. Why don’t Sellers have an Agent in their ear delivering advice, helping the property sell?
Simple. All agents are not created equal. How comfortable are YOU discussing money? Most people have an aversion to discussion regarding money. Asking a Seller to adjust condition, (which costs money) or lower the price, (which costs money)....can be difficult for the majority of people, and certainly the majority of agents.
As we head into the foyer of a nicer home in Leawood, I hear, “Do you have a frat house on today’s showing schedule?”. Husband walking back down the stairs to join us as family and I look at a beautiful kitchen, yells out, “Is that gal upstairs finished with her shower yet?”.
Couple walk into a split level listed in the mid 200s in Overland Park....Upscale neighborhood, nice curb appeal. We open the front door and stroll in....Wife says, “HA HA HA wow!!!! Love the mauve paint everywhere.” She goes on. “Hey check out that refrigerator....Is that mold in there? Maybe it's kind of like wine and cheese for a less-expensive home owner?
Husband responds, “Maybe it's kind of like wine and cheese for a less-expensive home?”
Is it better to put in a little elbow grease, spend a couple of bucks up front on minor repairs and at least get that prospective Buyer interested in coming back a second time?
Or, scare Buyers off from the start? Or worse yet, get a flock of low-ball offers? Maybe slows down the sale of your home for weeks....months?.
ALL of your home is under the microscope folks. These people want to buy your home to LIVE here, and will want to look into everything. A refrigerator full of mold and expired meat smell might well reflect a lack of care for the entire home.
All three of these Buyers wrote offers on OTHER HOMES.
