The two most important questions when interviewing a short sale agent to negotiate a short sale on your Overland Park home are: 1) How many short sales have you successfully completed? (If the answer is 15 or less, you might consider looking further)2) How is the BPO process handled? (If the real estate agent says something like "it just happens" or "the lender orders the BPO", then you may consider looking further) Why look further? Question: I have a home in Overland Park that I owe $367,000 on and it was recently appraised for a refinance for $325,000. I had my home appraised to lower the monthly payment and complete some deferred maintenance. I need a new roof, furnace, a/c, paint and carpet. Since I can't fix up the home now and can't sell for my loan amount, what should I do? I do not have the money to make the repairs and make the monthly mortgage payment. I feel like I continually fall further and further into debt. I would really like to sell but the only way I see this happening is to do a short sale. I would like to rent a home at a lower monthly payment to build up credit before purchasing a new (more affordable home) within the next five years.Kenny T. from Overland Park, KS. Question: I'm in the process of buying the home I rent in Overland Park, Kansas. The problem is my landlord is selling the home as a "Short Sale." My landlord’s real estate agent has prepared a hardship letter to his loan company asking them to accept a short sale… but he said that she needs us “the potential buyers” to get a prequalification letter from our mortgage lender. We got pre-approved for a mortgage in the amount the home is listed and sent it to the landlord's real estate agent. The real estate agent said he wants to show the mortgage lender that “the potential buyer is willing and able to pay the current assessed value of the home.” Is this normal or what? I just want to hear what someone else that is in the business thinks. Thanks.–Candy from Overland Park, Kansas Answer: It’s normal if you really want to buy the home and can really afford the home. When a short sale is being considered the mortgage company will look at the purchase contract between landlord and you, the potential home buyer. The mortgage lender wants to view the pre-approval letter, copy of the earnest money deposit in escrow, and the sales contract. Hope this helps, Candy.

“Martin, when we met regarding my financial situation, you assured me we would get to the bottom of things quickly, and thank goodness we did!
My friends had told me my situation was hopeless, that I had no other option than a foreclosure.
I hadn’t missed a payment, my credit score was good, but I couldn’t keep spending money from savings to make that house payment. I’d been downsized at work, medical bills were piling up.
My lender told me I needed to miss at least 2 payments to qualify for any help from them. And when I did apply for a loan modification, it took months to get an answer. What a joke!
The answer was they would lower my payment $105.00 per month...While I’m $112,000 upside down on my home?
So that takes me out of the frying pan for a few months, after that, right back into the fire! we listed our home with you, and we are on our way!
I’ve got a neighbor who needs help...But that first meeting can seem really scary! Ideas?
Answer- Avoid Scared by Being Prepared
The short sale listing appointment can be a super intimidating and scary meeting for any borrower that is considering listing and or selling his/her home as a short sale. Some borrowers will to tell you all about how awful their experiences have been with the lending institutions, how many months they have spent on a loan modification to no avail, and how much equity and sweat equity they have put in their homes.
When the prospective seller is unloading this information, it is important to be both patient and sensitive.
People don’t believe you care until you show them.
Even though you are already calculating the list price and quite possibly the commission, this may not be the meeting where you lay all the cards on the table. And, for this very same reason, it is often difficult to go through almost insurmountable number of items that need to be collected and discussed in one fell swoop.
Here’s how you can tackle that problem without overwhelming poor Mr. and Mrs. Neighbor-Seller:
- Seller Document Preparation When the listing consultation appointment is set, tell the sellers that you will need to review all of the following items at the meeting: mortgage statements, pay stubs, bank statements, tax returns.
- Agent Document Preparation Attend the listing appointment with your state and local paperwork completed already. Be prepared to write in the few items that need to be discussed before obtaining signatures.
- Short Sale Package Item Collection Collect and review the items that the seller provided. Discuss the hardship and have the seller write a five-sentence hardship letter before you leave the appointment.
- Financial Statement Bring a blank financial statement to the appointment and have the sellers complete it while you are dotting i’s and crossing t’s on paperwork or taking photos or measurements of the property.
The short sale listing appointment can go on for hours and be completely overwhelming, if it’s not planned for well in advance! The above list keeps it manageable, and the good news is that once you are gone, you are gone—out of your sellers’ hair for awhile: that is, until you meet again to present what will hopefully be multiple offers on their property.
The information the lender requires can appear to be very personal in nature, but remember, we’re asking the lender to let us off the hook for a bunch of money, and putting you back on the road to financial recovery!

A-Yes, as heard as it is to believe, Lenders pay a moving allowance for a clean, well-kept home.
There are several programs that offer a moving allowance. The HAFA (Home Affordable Foreclosure Alternatives) Program offers a moving allowance, based on the criteria outlined by the federal government. (Please see the link below.)
If you meet the guidelines, you could be eligible for $3500 and more, via HAFA.
There are programs offered by the specific lender as well. For example, Bank of America currently offers up to $2500 for participation in their short sale program. Again, you must meet all of the criteria to be eligible for the allowance.
Neither of these programs allows for negotiating the terms of any of the guidelines or conditions.
There are usually taxes owed on the allowance paid. The home owner pays them.
Jim, keep in mind, these allowances must be on all versions of the HUD that are delivered to the Lender. There are other procedural guidelines to meet as well.
