    Why look further? An experienced short sale agent may not have the best path for you to successfully negotiate a short sale on your behalf. Why would you consider an inexperienced short sale agent on such an important issue?

Since I can't fix up the home now and can't sell for my loan amount, what should I do? I do not have the money to make the repairs and make the monthly mortgage payment. I feel like I continually fall further and further into debt. I would really like to sell but the only way I see this happening is to do a short sale. I would like to rent a home at a lower monthly payment to build up credit before purchasing a new (more affordable home) within the next five years.

    Answer: Sorry to hear about your problem Kenny. If you can prove a financial hardship, you maybe able to short sale your home in Overland Park, Kansas.   • I'm in the process of buying the home I rent in Overland Park, Kansas. The problem is my landlord is selling the home as a "Short Sale."

    Question: I'm in the process of buying the home I rent in Overland Park, Kansas. The problem is my landlord is selling the home as a "Short Sale." My landlord’s real estate agent has prepared a hardship letter to his loan company asking them to accept a short sale… but he said that she needs us “the potential buyers” to get a prequalification letter from our mortgage lender. We got pre-approved for a mortgage in the amount the home is listed and sent it to the landlord's real estate agent. The real estate agent said he wants to show the mortgage lender that “the potential buyer is willing and able to pay the current assessed value of the home.” Is this normal or what? I just want to hear what someone else that is in the business thinks. Thanks.

    Answer: It’s normal if you really want to buy the home and can really afford the home. When a short sale is being considered the mortgage company will look at the purchase contract between landlord and you, the potential home buyer. The mortgage lender wants to view the pre-approval letter, copy of the earnest money deposit in escrow, and the sales contract.

    Answer: Even though the seller accepted a contract weeks ago the seller's lender still needs to approve the contract. The lender can either accept, decline or counter the contract. Many times as you have found out, the  lender will counter with paying no closing cost. You may counter with a higher offer and adding the closing cost back into the contract.

    Question: I have lived in my home in Overland Park, KS. for 15 years. Recently, my boss has announced that our department is moving to another state. I like my job really well and have decided to move with my department. I have interviewed 4 real estate agents and they all have me coming to closing with $15-25,000 after paying the mortgage off and closing cost. My wife and I don't have that kind of money. What do you recommend.

    Answer: Cliff you would not believe how many times a week I get this question. I too would find it hard to come up with that kind of money to sell my home. Since you live in Overland Park you must have refinanced your home or taken out a second mortgage. The market has slumped in Overland Park, but not that much. 


    I would recommend looking into a short sale. A job relocation is one of the reasons why some banks have been granting a short sale. When the loan payoff from the sale of a home is lower than the actual loan payoff, the representative you have hired to represent you request your  mortgage lender to take the lower amount. Your mortgage lender will review the facts and if the short sale makes sense, they will accept the short sale. If your mortgage lender accepts the short sale, typically you will not have to pay the difference at closing in your particular case of $15,000-20,0000.


    Hope this helps you. Short sales do have disadvantages so I would review the whole file with an experienced short sale specialist.

  • I'm thinking about making an offer on a home in Olathe, Kansas that is a short sale. How long does it take to close a short sale?

    Question: I'm thinking about making an offer on a home in Olathe, Kansas that is a short sale. How long does it take to close a short sale?

    Answer: Great question, Cathy. Since no two short same, I will address many types of short sales. A short sale that has been approved by the sellers lender should take 25-45 days to close. A short sale that has not been approved by the lender can take 45-6+ months. What delays a short sale that has not been approved by the lender is the lender will need financial docs from the homeowner. In addition, the lender will need to communicate with the investor(s), lien holders and insurance companies. The more entities that the lender needs to communicate with, the longer it will take to close. I'll give you a couple examples.


    Example 1: The homeowner has an on the ball short sale representative and the lender has approved the short sale prior to getting an offer. Now home buyer comes around and makes an offer and wants to close within 30 days. The likelihood of this happening is very good.


    Example 2: The homeowner has hired a short sale representative to present the short sale to the lender. The short sale representative waits until an offer is received before they present any docs to the lender. Once the docs are presented, the lender request financials. During the process, the lender needs to communicate with their investor and PMI insurance company. Also during the process the short sale representative finds out that there is a home equity line of credit and a tax lien on the property. The short sale representative will need to present a short sale request to the home equity line of credit lender as well negotiate with the IRS regarding the tax lien. The buyer wants to close within 45 days according to the contract. Best guess, it will take 3-6 months minimum to close this contract.

    Answer: Well Greg. You're not going to like my answer. Yes, your lender has the right to foreclose on your Overland Park, KS. house and order the Johnson County Sheriff to auction off your house to recover losses.


    I would first recommend contacting an attorney to help you. If you do not know of a good attorney. I'll recommend one at the end of my answer. In Kansas, a mortgage lender has strict guidelines on how to foreclose on your house. Next, after the sheriff sale, a Kansas homeowner has at minimum of 90 days to redeem the sale.


    Before the sheriff sale, you may also request a short sale from your mortgage lender. If you need guidance on this, feel free to contact the Dowell Taggart Team.

My offer was 90% of the seller’s asking price.

    A. The quick answer is YES the buyer can call the seller's mortgage lender. The long answer is No they should not contact the seller's mortgage lender and here is why:
    1) The listing agents job is to market the home and get the best and highest offer on the seller's home. If the buyer is calling the mortgage lender, they are sending a message that they are anxious. This will almost always guarantee a counter offer. 
    2) The mortgage lender will be forbidden to discuss personal information about the seller and their finances to the home buyer. So the home buyer will not get the full scoop.
    3) The loss mitigation or prevention representative from the mortgage lender is over worked. The last thing they want is another contact on the file. They prefer only 1 contact. Once an authorized person contacts the representative on a short sale file, the representative will most likely be required to have the legal department review the file for up to 21 days. This is will most likely delay the file.
    4) Many short sales are negotiated on Equator, a software that many banks prefer to use  to negotiate short sales recently. In many cases the listing agent communicates with a middle person and never communicates with the mortgage lender anymore. 


    Hope this helps. I would not recommend contacting the mortgage lender. I would recommend asking for more or better communication from the listing agent.
