  • We recently purchased a house in Overland Park, Kansas. We have now found out that our house has very high radon levels.

    Question: We recently purchased a house in Overland Park, Kansas. We have now found out that our house has very high radon levels. The inspector nor our real estate agent requested a radon test or informed us that we should do a radon test. Is this required in Overland Park? Am I stuck having to pay for the mitigation system due to the lack of advice from the professionals that assisted with the transaction?

    Answer: Thanks Jackie for contact me. First, radon inspections are not required. Second, I'm not sure that a radon inspection may have revealed the very high radon levels. A radon test measures the amount of radon only during the test period. The air pressure and weather has an effect on the radon levels in your basement. When a radon test reveals a high radon level, I would recommend testing again. If the second test reveals a high radon level, then a radon mitigation system will need to be installed.


    Now the question, who pays for it. I'm assuming you used our KCRAR board real estate forms. In those forms it states that the buyer has the right to inspect the home, even for radon. It is important to read and understand the contracts you are signing. If you don't understand the contracts you are signing, consult an attorney.


    You could consult an attorney about your options in this matter of re-cooperating your expenses for the radon mitigation system, but I would guess that the radon mitigation system would be less than pursuing the real estate agent with an attorney. 


    You might look into small claims court instead. Although this is an option, my guess is that since you signed the contract and it is spelled out in the contract, you maybe unsuccessful in small claims court. 


    When hiring a professional, do your research and ask questions. If your questions are not being answered, maybe they are not a good fit for you.

  • I’m very interested in buying a bank foreclosure home in Olathe, Kansas. I have looked at the home without an agent and wanted to make an offer on the home yesterday. The listing real estate agent advised me to wait

    Q: I’m very interested in buying a bank foreclosure home in Olathe, Kansas. I have looked at the home without an agent and wanted to make an offer on the home yesterday. The listing real estate agent advised me to wait because there were two other buyers who had an offer with the out of state bank and that the bank had to make a decision if one of those offers would be accepted before I could give an offer. Is this true? I would think the bank would want all the offers it could get before making their decision. I feel the listing agent, has someone in mind to buy this home and it’s not me.

    The Realtor doesn’t seem to want to talk to me about this property. I’m cut short on the phone when I call, and she doesn’t call me when she says she will call so I call her. I’m not sure what to do. Should I go to another Realtor who doesn’t have this property listed? I have never purchased a home before and I don’t understand all the things about buying a home. I was hoping the agent would help me understand but the agent doesn’t offer any help. I’m confused and don’t know what to do. I would like to make an offer but how do I do that if this office won’t take one? Please help me understand….

    Answer: I would not stop by Go and go immediately get and get a new real estate agent who specializes in Olathe, Kansas. One that knows the ins and outs of buying foreclosure properties and working with first time home buyers would be a plus.

    Banks take so long to negotiate because they are evaluating and you're right, banks want to see ALL OFFERS. If you wait to write your offer, it may be too late.

    Unfortunately, some agents feel they are “wasting time” by writing an offer when there are already 2 strong offers in place. Some maybe lazy, others don't understand the process.

    Don’t waste your time chasing an agent who will not answer your questions and gives you the impression they don't want to work with you. A quality real estate agent will WANT you as a client for the current purchase and will know that if the current offer doesn’t get accepted, they can write your next offer too.

    Find a new real estate agent that will first sit down with you and explain the process and will write your offer for you today.

    You need to understand that you will need a pre-approval from a mortgage lender and an earnest deposit to make an offer.

    Answer: If you have actually signed a contract to sell your home to a buyer and it has been delivered to the buyer, you have a legal obligation to do so. The buyer will have recourse against you if you break the contract with the them. If the first buyer is still in their due diligence period, you maybe lucky and the buyer backs. The buyer could offer to renegotiate. 

    If you're past the due diligence period and the second offer looks much stronger, have your agent contact the agent representing the first buyer and enter a friendly discussion. Have your agent ask them if they would like to get out of the contract, you never know. If they say yes, your good to go. If they say no, I would recommend contacting a real estate attorney for advice.

    Question: What is the difference between assessed value and fair market value? I have noticed that most homes in Overland Park have been selling above the assessed value.

    Answer: The assessed value is the valuation placed on a property by a public tax assessor for purposes of taxation. The assessed value is NOT the actual value of the home and is some cases may be far from the actual value. The Fair Market Value of a home on the other hand is the agreed upon sales price between a willing and informed buyer and seller under USUAL and ordinary circumstances. That doesn't mean a distressed home or a seller selling a home to a relative at a reduced price is the Fair Market Value. The Fair Market Value is the highest price which the property will bring when exposed for sale on the open market to a buyer who is purchasing with full knowledge of the properties highest and best use.

  • I am purchasing a single family foreclosure home in Kansas City that is bank owned and there is a delay in closing due to the title

    Question: I am purchasing a single family foreclosure home in Kansas City that is bank owned. According to neighbors, the home that has been vacant for a year and a half. The bank accepted my offer and I submitted an earnest check in early November, 2011. A clear title seems to be the delay. My question is do banks put homes on market without clearing liens and loans?

    Answer: Stan, I hope you're working with a real estate agent. If not, your real estate purchase could get tricky. Yes, it is common for banks to put homes on the market before they have clear title. In addition, it is not uncommon for liens to pop up on the home after the foreclosure process. Once the contract was accepted, the contract was probably sent to a title company to start the title process. 


    As a real estate agent, I have typically have a title company pull a title commitment the first week.Also typically before closing, I will get a call from the title company that a lien as just been issued on the foreclosed home. The liens can be tax liens, home association liens or a mechanic liens. In addition, sometimes, the title was not cleaned up when the home was foreclosed on by the bank and the title company may have missed the liens.


    On a foreclosure home, the liens should be cleared up fairly fast. If they are not, as in your case, I would suggest contacting the title company directly and ask them why there is a delay in closing. Maybe paying off a small lien can solve the problem.

    Answer: Well Greg. You're not going to like my answer. Yes, your lender has the right to foreclose on your Overland Park, KS. house and order the Johnson County Sheriff to auction off your house to recover losses.


    I would first recommend contacting an attorney to help you. If you do not know of a good attorney. I'll recommend one at the end of my answer. In Kansas, a mortgage lender has strict guidelines on how to foreclose on your house. Next, after the sheriff sale, a Kansas homeowner has at minimum of 90 days to redeem the sale.


    Before the sheriff sale, you may also request a short sale from your mortgage lender. If you need guidance on this, feel free to contact the Dowell Taggart Team.

    Answer: I will give you a few great suggestions for finding a great real estate agent in St. Louis.


    First, ask neighbors, friends and family members in the area. Surely somebody has a great referral.
    Second, Google your city and community and read the bios from the top agents in the area.
    Third, call a few agents who have listings in the area.
    Fourth, the Dowell Taggart Team would be happy to refer a great real estate agent. We'll need some additional information so we can do a pre-screen of agents.


    When choosing a listing agent, interview 3 real estate agents. Ask questions that will determine experience, knowledge of the area, their marketing plan for your home, honesty and availability.


    A great agent will market your home on the first page of Google, will have an award winning website and will be proficient with social media. Check them out on social media and see how many friends and followers they have. Great agents will have a mass following.

    Answer: I would contact an Olathe or Gardner, KS. real estate agent first and schedule a meeting so you can discuss what your needs and wants are at the time. They will also help you determine your needs for the near future. After determining your needs and wants, a real estate agent will help you find a mortgage loan officer.  

    It is always important to get pre-approved BEFORE you start the home shopping process. Buyers and their agents that choose not to do so are like shoppers that head to the grocery store without their wallets. Like who really goes to the grocery store to window shop. 

    Getting a mortgage, or rather getting a full mortgage loan pre-approval, lets a home buyer and their real estate agent know what he can to afford when looking for a home in Olathe or Gardner, Kansas. It is critically important for a potential buyer to go through the pre-qualification steps and learn exactly what is required to secure a mortgage.
    Buyers have many options to choose from when looking for a mortgage. There are banks, mortgage brokers, finance companies, credit unions and private lenders.     Recently, I was contacted by a homeowner who is currently living in Dallas and owns a home in Overland Park, Kansas. She and her family are preparing for a job relocation to Dallas, Texas in a month. Due to the slow real estate she will need to move to Dallas before her home is sold in Overland Park. As many homeowners have found out in the past couple years, it is hard to maintain a house from another location, much less sell it. Here are a few pearls of wisdom for those who find themselves forced to sell from another state.

    Build a Team

    When you’re in another city and trying to sell, you must get yourself a good team. Let’s face it – a house needs continual maintenance.  Do not leave this type of activity to friends, relatives or family — those situations almost always end badly. Find true professionals that can help maintain your home before you leave if possible. You want to be sure that everyone on your “sales” team treats this as a business transaction, not a “nice-thing-to-do.”

    Most Important Person

    The first most important person on the team is your real estate agent. Not any real estate agent, but a solid, well-connected agent who has helped relocate homeowners and understands the task that need to be accomplished. Did you know that 20% of the real estate agents in any area sell 80% of the homes? Now you may understand why you need to hire a true professional. Since you are living in another state like Texas, make sure they are technically and virtually savvy and  can connect via email, voice mail, and texting, if need be.  Ease of communication with your real estate agent is very important. As the home seller,  you will have to do your part in responding quickly and timely to requests — it is a two-way street!

    Mr. Handyman

    The next person on your team is the reliable and dependable handyman. Preferably, not the unemployed guy down the street. This is the person who may have already done work on your home while you lived there, so you already know their work ethic. Of course, your real estate agent can recommend handymen if you’re not familiar with any. Keep in mind, the handyman will need accessibility to your home. Ideally you want someone who you can email or consistently reach over the phone at a defined time daily, and can accept checks or credit card payments, since sending cash may not be an option.

    Important issues to address with your handyman is caring for your home during the cold winter, after storms and during plumbing catastrophes.

    Stage it

    To round out the team, hire a local home stager or interior deorator,, especially if you are looking to sell an empty Olathe or Overland Park home. Homes in Olathe and Overland Park, KS. sell faster and for more money than vacant homes. Most home buyers can’t visualize furniture in an empty house.  A home stager who specializes in vacant homes would be a great asset on your team. Like the handyman, the home stager should be easily accessible and able to accept payments virtually.  They can provide, or advise, on the presentation of your property, especially important when you are not in town. Home stagers can make it look as if the homeowners are still in town and ready to sell!  Home stagers can help you utilize current  furniture or else secure furniture from local stores to help accent and provide an inviting home to potential home buyers.  Also, the stager can act as an impartial party to review the work of the handyman/contractor, help be your eyes and ears on site. Some home stagers will provide weekly services like adding fresh flowers to help create a pleasant atmosphere for potential home buyers. Your real estate agent can help you identify a home stager to help you sell your property.

    Mrs. Clean

    Although you will not be living in the home a cleaning service or person will be helpful to clean after you move out as well as clean until the sell takes place. Dusting, removing dirt that is tracked in and tiding up after showings will send a positive message to potential buyers. Daily cleaning since you’re not there will not be necessary. My offer was 90% of the seller’s asking price.

    A. The quick answer is YES the buyer can call the seller's mortgage lender. The long answer is No they should not contact the seller's mortgage lender and here is why:
    1) The listing agents job is to market the home and get the best and highest offer on the seller's home. If the buyer is calling the mortgage lender, they are sending a message that they are anxious. This will almost always guarantee a counter offer. 
    2) The mortgage lender will be forbidden to discuss personal information about the seller and their finances to the home buyer. So the home buyer will not get the full scoop.
    3) The loss mitigation or prevention representative from the mortgage lender is over worked. The last thing they want is another contact on the file. They prefer only 1 contact. Once an authorized person contacts the representative on a short sale file, the representative will most likely be required to have the legal department review the file for up to 21 days. This is will most likely delay the file.
    4) Many short sales are negotiated on Equator, a software that many banks prefer to use  to negotiate short sales recently. In many cases the listing agent communicates with a middle person and never communicates with the mortgage lender anymore. 


    Hope this helps. I would not recommend contacting the mortgage lender. I would recommend asking for more or better communication from the listing agent.

    A: Not only will you be adding a ground level bathroom (whether it is a full bath, 3/4 bath or half bath) but bringing the laundry room to the main floor will help in the marketability when you decide to sell. I suggest adding at least a 3/4 bath, but if you're limited on space just adding another bathroom on the main floor will definitely help.This small addition will add considerable value to your home. Just make sure to obtain the property building permits so everything is legal and be sure to hire a reputable licensed general contractor to do the work. If you would like I can give you solds in your area with 1 bath and solds with 1.5 baths so you can view the difference in value.
