    Answer: If you saw the information on a syndication site like Zillow or Trulia, there is a possibility that the listing information was pulled incorrectly. Ask for a printout of the MLS sheet from the MLS. If the information is indeed incorrect, have a talk with your real estate agent. If the problem is not corrected promptly, discuss the problem with your real estate agents managing broker.


    A listing contract is a contract. If you want to cancel the contract without the other party agreeing to the cancellation, you will need an attorney.

  • Bank accepted an offer on an Overland Park, Kansas foreclosure home in 2 hours on a Sunday night

    Question: I have been in the market for a home for over 6 months. The perfect home came on the market Friday in Overland Park. It had already been rehabbed by the bank and seemed to be in great shape. All it needed was new decor. Sunday I made an offer on the Overland Park foreclosure home that I thought was reasonable. The list price was $185,000 and my offer was for $191,000 submitted with a $2,500 deposit. I was also putting 20% down. My buyers agent verified through the listing agent that there were no other offers on the house and my agent submitted my offer to the listing agent around 4:00 PM on Sunday night. So I get a text message from my agent at about 5:30PM saying that she just received an email from the listing agent saying that a cash offer has been accepted by the bank on the home I wanted. I want to know what could have happened in those few hours, I have a suspicion of something done under hand. Should I look further into it, or do these things happen often?

    Answer: Unfortunately these things happen when buying a foreclosure home. I personally have not seen a bank work that fast, but I guess it is possible. I doubt that the listing agent just received the offer and presented it to the bank and they accepted it that fast on a Sunday. I don’t blame you for being suspicious, but Banks are not in Real Estate business and they don’t follow any rules. As far as the listing agent, they just act on behalf of their seller or asset manager.

    Question: I have lived in my home in Overland Park, KS. for 15 years. Recently, my boss has announced that our department is moving to another state. I like my job really well and have decided to move with my department. I have interviewed 4 real estate agents and they all have me coming to closing with $15-25,000 after paying the mortgage off and closing cost. My wife and I don't have that kind of money. What do you recommend.

    Answer: Cliff you would not believe how many times a week I get this question. I too would find it hard to come up with that kind of money to sell my home. Since you live in Overland Park you must have refinanced your home or taken out a second mortgage. The market has slumped in Overland Park, but not that much. 


    I would recommend looking into a short sale. A job relocation is one of the reasons why some banks have been granting a short sale. When the loan payoff from the sale of a home is lower than the actual loan payoff, the representative you have hired to represent you request your  mortgage lender to take the lower amount. Your mortgage lender will review the facts and if the short sale makes sense, they will accept the short sale. If your mortgage lender accepts the short sale, typically you will not have to pay the difference at closing in your particular case of $15,000-20,0000.


    Hope this helps you. Short sales do have disadvantages so I would review the whole file with an experienced short sale specialist.

    Question: I have a question about firing my Overland Park REALTOR. I found a property in Overland Park on REALTOR.com that  I was interested in and requested a showing online. I was contacted by a REALTOR, who was not the listing agent,  who offered to show me the property and act as my REALTOR. I liked the property in Overland Park and requested the REALTOR to make an offer. Instead of putting the offer in writing, the REALTOR presented a verbal offer to the listing agent. I have been trying to get a hold of my REALTOR and they havent been getting back to me or performing the tasks I have asked. I dont think the buyer is acting in my best interest and I now would like to use another REALTOR. I have not signed any paperwork with this REALTOR. My question is can I contact another REALTOR to make a written offer on this property without legal consequences?

    Answer: Real estate contracts in Kansas are not enforceable unless they are in writing. Since it appears that you have NOT signed any contracts with this REALTOR, you have indeed NOT hired this REALTOR. Many buyer Realtors fail to have their clients sign a buyer representation agreement, which is good in your case.

    It sounds like this REALTOR is not representing you so I would find another Overland Park REALTOR to represent you as the buyer and make the offer. Time is of the essence so I would interview qualified Overland Park REALTORS quickly. If the home sold, you may lose out.

    Since attorneys are the only ones who can provide you a legal answer, I would contact an attorney for legal advice. If you need a referral of an attorney, feel free to contact me.

    Answer: Great question, Jim and Carol. I get asked questions about color and decor quite often. Although the color of your home may appeal to your wife, any color that is not neutral will appeal to fewer people. When selling your Overland Park, KS. home I recommend keeping the colors throughout your home a neutral color. That includes the exterior. Neutral colors will appeal to a wider audience of home buyers. A neutral color that is the most common for exterior colors is an off white. You kind of want a mix between a white and a yellow.

  • I'm thinking about making an offer on a home in Olathe, Kansas that is a short sale. How long does it take to close a short sale?

    Question: I'm thinking about making an offer on a home in Olathe, Kansas that is a short sale. How long does it take to close a short sale?

    Answer: Great question, Cathy. Since no two short same, I will address many types of short sales. A short sale that has been approved by the sellers lender should take 25-45 days to close. A short sale that has not been approved by the lender can take 45-6+ months. What delays a short sale that has not been approved by the lender is the lender will need financial docs from the homeowner. In addition, the lender will need to communicate with the investor(s), lien holders and insurance companies. The more entities that the lender needs to communicate with, the longer it will take to close. I'll give you a couple examples.


    Example 1: The homeowner has an on the ball short sale representative and the lender has approved the short sale prior to getting an offer. Now home buyer comes around and makes an offer and wants to close within 30 days. The likelihood of this happening is very good.


    Example 2: The homeowner has hired a short sale representative to present the short sale to the lender. The short sale representative waits until an offer is received before they present any docs to the lender. Once the docs are presented, the lender request financials. During the process, the lender needs to communicate with their investor and PMI insurance company. Also during the process the short sale representative finds out that there is a home equity line of credit and a tax lien on the property. The short sale representative will need to present a short sale request to the home equity line of credit lender as well negotiate with the IRS regarding the tax lien. The buyer wants to close within 45 days according to the contract. Best guess, it will take 3-6 months minimum to close this contract.

  • I would like to know if I can terminate a buyer agreement that I signed with an Overland Park, Kansas real estate agent?

    Question: I would like to know if I can terminate a buyer agreement that I signed with an Overland Park, Kansas real estate agent? My wife and I are not happy with the lack of professionalism with this real estate agent. First she conducted herself in a poor manner when we went to look at our #1 home for the second time. She did not inform the listing agent it was our second viewing, she was 45 minutes late (and did not call us), brought her 3 elementary age kids to the showing and showed up without comparables and the sellers disclosure as she said she would. When we sat down to discuss writing an offer, she forgot the paperwork that she said she would bring and she provided no consultation. As first time home buyers she did even consult with us about making a counter-offer or how the process goes. Thanks!

    Answer: Sorry for your problems. Laura. First read your Buyer’s Agreement that you signed as it would disclose under what (if any) conditions it can be terminated prior to its expiration. If you don't have any lck there, schedule a meeting with your buyer's agent and see if you can come to a remedy. If that doesn't work, contact her broker. Discuss your concerns with the broker, ultimately it doesn’t benefit either of you to be ‘stuck’ with each other. If the broker doesn't offer an agreeable remedy, contact an attorney. Best of luck.
