Question: I would like to know if I can terminate a buyer agreement that I signed with an Overland Park, Kansas real estate agent? My wife and I are not happy with the lack of professionalism with this real estate agent. First she conducted herself in a poor manner when we went to look at our #1 home for the second time. She did not inform the listing agent it was our second viewing, she was 45 minutes late (and did not call us), brought her 3 elementary age kids to the showing and showed up without comparables and the sellers disclosure as she said she would. When we sat down to discuss writing an offer, she forgot the paperwork that she said she would bring and she provided no consultation. As first time home buyers she did even consult with us about making a counter-offer or how the process goes. Thanks!Laura N. from Overland Park, Kansas Answer: Sorry for your problems. Laura. First read your Buyer’s Agreement that you signed as it would disclose under what (if any) conditions it can be terminated prior to its expiration. If you don't have any lck there, schedule a meeting with your buyer's agent and see if you can come to a remedy. If that doesn't work, contact her broker. Discuss your concerns with the broker, ultimately it doesn’t benefit either of you to be ‘stuck’ with each other. If the broker doesn't offer an agreeable remedy, contact an attorney. Best of luck. Regarding your rental options. Nearly ever management company and landlord will do a credit check these days. It is best to be upfront and honest with the management companies and landlords. They're going to find out anyways on the credit search. You may talk to some landlords from Craigslist and to some larger apartment complexes that have a large number of vacancies may be a little more lenient. In addition good references may help. With as many foreclosures as there are in Kansas City, this will not be the first time a landlord or rental manager has talked to someone with a real estate foreclosure. You will be able to find a rental property.

Question: I'm in the process of buying a home in Kansas City with my husband. We're first time home buyers. We have been looking at homes in Olathe and Overland Park, Kansas. We have been going over my potential cost to buy the home and my husband thinks we can save some expenses by not getting a home inspection. He thinks we can skip the inspection because he has have picked up many habits from his dad who is a carpenter. Do you think this is wise? Answer: A home inspection when buying a home may seem, at times, unnecessary expense when looking at new homes and homes that appear to be in great shape. A homes inspection is much like a physical. Just like yearly physicals are necessary, a home inspection is necessary. How many people do you know who have found out about a illness at a physical? Sure we hope we come out of the physical hoping everything is ok, but some people don't. Just like a physical, a home inspection is to give the home buyer the peace of mind and potential protection against future calamity. 16 years ago I had a couple building a home, I recommended a home inspection. The buyer did not want to do a home inspection. It was a week before closing and the buyer asked me, "what is it going to take to get you to stop requesting a home inspection."
I told him, "by getting a home inspection."
Even though the buyer was using a builder with a great reputation, he decided to get the home inspection. Boy was he glad. Not only did the inspection reveal some minor problems like reverse polarity on the electrical outlets and a small hole in a plumbing pipe, it revealed a major problem. The heat exchanger on the furnace was cracked. If he would have moved his family into his new home right before Christmas as planned, there would have been a chance that his family would have been killed. Remember, this home was a new home.
That is a home buyer who was happy I insisted on getting a home inspection. After 22 years of real estate, I can give you more stories with a similar ending.
Not only can inspections save your life, they can give you a true picture of the home. Many home buyers use the home inspection as a list of items to repair around the home for the next couple years after purchasing.
No, I would not skip the home inspection. Also, not all inspectors are the same. Don't hire an inspector because of their fee. Hire a qualified inspector who will thoroughly inspect a home. A home inspector who takes less than an hour and a half to inspect a home in Overland Park or Olathe has not thoroughly inspected the home.

Question: We recently purchased a house in Overland Park, Kansas. We have now found out that our house has very high radon levels. The inspector nor our real estate agent requested a radon test or informed us that we should do a radon test. Is this required in Overland Park? Am I stuck having to pay for the mitigation system due to the lack of advice from the professionals that assisted with the transaction?Jackie R. from Overland Park, KS. Answer: Thanks Jackie for contact me. First, radon inspections are not required. Second, I'm not sure that a radon inspection may have revealed the very high radon levels. A radon test measures the amount of radon only during the test period. The air pressure and weather has an effect on the radon levels in your basement. When a radon test reveals a high radon level, I would recommend testing again. If the second test reveals a high radon level, then a radon mitigation system will need to be installed. Now the question, who pays for it. I'm assuming you used our KCRAR board real estate forms. In those forms it states that the buyer has the right to inspect the home, even for radon. It is important to read and understand the contracts you are signing. If you don't understand the contracts you are signing, consult an attorney. You could consult an attorney about your options in this matter of re-cooperating your expenses for the radon mitigation system, but I would guess that the radon mitigation system would be less than pursuing the real estate agent with an attorney. You might look into small claims court instead. Although this is an option, my guess is that since you signed the contract and it is spelled out in the contract, you maybe unsuccessful in small claims court. When hiring a professional, do your research and ask questions. If your questions are not being answered, maybe they are not a good fit for you. Q: I’m very interested in buying a bank foreclosure home in Olathe, Kansas. I have looked at the home without an agent and wanted to make an offer on the home yesterday. The listing real estate agent advised me to wait because there were two other buyers who had an offer with the out of state bank and that the bank had to make a decision if one of those offers would be accepted before I could give an offer. Is this true? I would think the bank would want all the offers it could get before making their decision. I feel the listing agent, has someone in mind to buy this home and it’s not me.
The Realtor doesn’t seem to want to talk to me about this property. I’m cut short on the phone when I call, and she doesn’t call me when she says she will call so I call her. I’m not sure what to do. Should I go to another Realtor who doesn’t have this property listed? I have never purchased a home before and I don’t understand all the things about buying a home. I was hoping the agent would help me understand but the agent doesn’t offer any help. I’m confused and don’t know what to do. Answer: I would not stop by Go and go immediately get and get a new real estate agent who specializes in Olathe, Kansas. One that knows the ins and outs of buying foreclosure properties and working with first time home buyers would be a plus. Banks take so long to negotiate because they are evaluating and you're right, banks want to see ALL OFFERS. If you wait to write your offer, it may be too late. Unfortunately, some agents feel they are “wasting time” by writing an offer when there are already 2 strong offers in place. Some maybe lazy, others don't understand the process. Don’t waste your time chasing an agent who will not answer your questions and gives you the impression they don't want to work with you. A quality real estate agent will WANT you as a client for the current purchase and will know that if the current offer doesn’t get accepted, they can write your next offer too. Find a new real estate agent that will first sit down with you and explain the process and will write your offer for you today. You need to understand that you will need a pre-approval from a mortgage lender and an earnest deposit to make an offer. Question: I have accepted an offer on my home in Overland Park, last night. My real estate agent just called me to schedule an appointment to present another offer. The offer he wants to present is for more money. What are my options? Jack - Overland Park, Kansas
Answer: If you have actually signed a contract to sell your home to a buyer and it has been delivered to the buyer, you have a legal obligation to do so. The buyer will have recourse against you if you break the contract with the them. If the first buyer is still in their due diligence period, you maybe lucky and the buyer backs. The buyer could offer to renegotiate.
If you're past the due diligence period and the second offer looks much stronger, have your agent contact the agent representing the first buyer and enter a friendly discussion. Have your agent ask them if they would like to get out of the contract, you never know. If they say yes, your good to go. If they say no, I would recommend contacting a real estate attorney for advice.

Real Estate Assessed Value VS Fair Market ValueQuestion: What is the difference between assessed value and fair market value? I have noticed that most homes in Overland Park have been selling above the assessed value.Janet L. from Overland Park, Kansas Answer: The assessed value is the valuation placed on a property by a public tax assessor for purposes of taxation. The assessed value is NOT the actual value of the home and is some cases may be far from the actual value. The Fair Market Value of a home on the other hand is the agreed upon sales price between a willing and informed buyer and seller under USUAL and ordinary circumstances. That doesn't mean a distressed home or a seller selling a home to a relative at a reduced price is the Fair Market Value. The Fair Market Value is the highest price which the property will bring when exposed for sale on the open market to a buyer who is purchasing with full knowledge of the properties highest and best use.

Missing Overland Park Johnson County Community College Student that went missing from the Kansas University Edwards Campus Found In an odd development last night, Aisha Kahn, the missing Johnson County Community College student, was found alive last night. In a brief press conference, it was announced that Aisha was not abducted against her and she was found safe. Now is there anyone else scratching there head on this? She made a frantic phone call to her sister. When her sister arrived, she was missing. Her bag and phone was found on a bench. There have been pleas from family on tv, press conferences regarding her possible abduction, FBI involvement, and over 40 police officers helping in the search in efforts to find Aisha. Now the case is closed with no answers addressed. How will future missing twenty year old cases be handled? I'm sure this case will have an effect, don't you?

Overland Park, Kansas man is indicted for selling bogus Facebook stock Ronald Catrell of Overland Park, Kansas faces fraud counts for an alleged scheme to sell fake investments in social networking company Facebook Inc.
A U.S. Attorney said late Friday that Ronald Catrell, 45, had been charged with three counts of bank fraud, one count of money laundering, one count of wire fraud and one count of aggravated identity theft. Catrell allegedly set up Blue Valley Capital Management LP. He then told investors he could buy Facebook stock through Goldman Sachs. At the time Facebook actually was not publicly traded. Victims gave Catrell thousands to buy the bogus Facebook stock.
