Overland Park KS - We had a short sale recently with a certain loan servicing company.
The funny thing was that this loan servicer was hired by the owner of the loan to work on behalf of them. In other words, the loan servicer was to look out for the loan owner's best interest.

Processing and approving a short sale will usually avoid future losses on a mortgage. Boston Consulting Group recently did a study on the difference between a short sale and foreclosure. They found that a short sale dramatically reduces future losses when compared to a foreclosure.
Here is a real life example: One lender rejected a 385k short sale offer. The home was foreclosed upon and put up for sale. It sold for $230,000. We estimate the owner of the loan, Fannie Mae, lost $182,000. We have seen this happen over and over again with short sale offers. The loan servicers drag their feet on processing the short sale.
The home is later foreclosed upon and sells for substantially less. But, we had never seen a loan servicer work against their customer / client's best interest. Until we saw a short sale approval letter come across our desk. The loan servicer was asking for a $2,500 fee to be paid to them. If it wasn't paid they wouldn't approve the short sale. I was shocked. "Aren't you required to work in your client's best interest?", I asked them.
The woman at the loan servicer replied, "Well, we checked it out with our legal department and the said it is ok." I don't really understand what she meant by "ok." This company is not working in their client's behalf.
The loan servicer actually has a fiduciary duty to do what is best for the owner of the loan. And putting a roadblock in the way of approving short sales isn't doing what is best for their client.
So, what does this mean to you?
In my opinion, it gives you a strong basis for a lawsuit against that loan servicing company if your loan modification or short sale isn't approved because you won't pay their fees.

Overland Park KS - Most people think the person they mail their mortgage payment to every month is the owner of their loan. Not so. In fact, most of the time, they are not the owner. As an example, 80% of all loans that Bank of America handles are not owned by Bank of America.

The largest owners of US mortgages are two companies that some would allege are owned by Uncle Sam. They are Fannie Mae and Freddie Mac. They own an estimated 55-60% of all US Mortgages. Another estimated 10-15% are insured by Uncle Sam as well, thru the FHA and VA loan guarantee programs.
Another estimated 10-15% are owned by Wall Street Firms, Pension Funds, and other entities. That means the company you mail your check to every month is essentially a hired gun. They are paid to collect payments, handle accounting and escrows, collect on delinquent accounts, and act as the front person for the owner of the loan.
They forward the money received to the lender, minus a small fee to themselves. This small fee on thousands of mortgages means they are paid very well. In fact, the business is so profitable that IBM Computers opened a subsidiary loan servicing company.
Now that I have laid the groundwork, let me explain how the loan servicing companies have worked against the loan owners best interest.
Acting as a servicer puts them close to the legal equivalent of a trustee. This means they can do whatever they want to, right? No. Let me explain.
See, a trustee has a fiduciary duty to whoever they represent. They are required to act in their client’s best interest. If they do not do this, then they can be legally liable for any loss their loan owner incurs as a result of the trustee’s negligence.
Just as real estate agents are required to act in their client’s best interest, loan servicers are also required to act in their client’s best interest.
Let’s say an agent listed a house and double sided it to a buyer for 200k. A 225k offer came in earlier, but the agent never presented it to the seller.
Do you think the seller would be angry? Of course they would be. Or, let’s say you managed an apartment community. You only had a leasing person on site one day a week. You did this to save money. As a result the apartment complex only leased half of their apartments for the next year. You caused them to lose half of their year’s rents. Would that apartment manager be unhappy? You bet they would be. The loan servicers are doing the same thing.
Here are a few examples of them breaching their fiduciary duty to their clients.
Example #1: Not giving buyers an answer on a short sale within a reasonable time period. Loan servicers should help their investors recoup as much money as possible from short sales.
Example #2: Turning down loan mods that amortize at a higher value than what is netted on a short sale or thru REO.
Let me explain in a little more detail. A homeowner had a reduction in income and can’t afford his original mortgage payment. The borrower has a stable income and agrees to pay $1,000 a month for the next 30 years. $1,000 a month for 30 years, at a 6.5% interest rate will repay a $158,210 mortgage. The loan servicer turns down the loan mod and forecloses. The house sells for $125,000 as an REO and the servicer nets $115,000. Did the loan owner lose money? I think most people would agree that they did. Obviously there are other factors involved, but I think they would have done better if they had approved the homeowner’s offer.
Example #3: Not listing foreclosed properties quickly enough.
I have witnessed several examples of banks foreclosing on a house and then taking 6 months to a year to put it up for sale. As an example, there was a house foreclosed on September 9th, 2009. It was finally listed for sale 7 months later, in May 2010. Say what you want, but waiting 7 months to put a property on the market is pathetic. If the mortgage holder had been an individual, do you think they would have listed the house a little faster than 7 months?

Overland Park KS - I am following up on a question from Arman. His loan was owned by Fannie Mae and the company handling the loan for Fannie Mae was rejecting an excellent short sale offer for no reason.

When you get in front of a jury and show how this company’s negligence caused Fannie Mae to lose $15,000 (what I project they will lose) and that it hurt him as well, the jury will award damages in a heartbeat.
Here are some of the damages a foreclosed homeowner might be able to ask for. Credit Damage.
A foreclosure is much more damaging long term to your credit than a short sale. For the next 7 years they will have to answer yes to the standard question that is on most credit applications: "Have you had property foreclosed upon or given title or deed in lieu thereof in the last 7 years?"
Harm from a potentially larger amount being owed to the owner of the loan.
If the short sale was turned down, and as a result the home sold for less as a foreclosure, they owner of the loan could pursue the homeowner for more money.
This would be a much easier argument after the foreclosed home sold and you have a copy of the sale prices of the home and the original short sale offer in hand.
These are two things I can think of that are the most likely to be approved by a jury. If you can think of additional damages, then please post them in the comments section below.
There is something else very interesting this home seller told me.
When he talked to a women at the lender and asked why they were rejecting the short sale offer, she replied "We or some of our investors will buy it.” That sounds pretty fishy to me.
I have seen other people who handle loans for a third party owner profit from the loan owner’s loss. For example, one company charges the buyer a $1,500 to $5,000 fee for buying the short sale. If the buyer won’t pay, then they won’t approve the short sale. Remember, they are being paid by the owner of the loan. In fact, they are paid very well. The business is so profitable that IBM Computers recently opened a subsidiary loan servicing company.

Are you interested in foreclosure properties in Johnson County Kansas? Mortgage giant Fannie Mae announced a new incentive program to help sell off their growing inventory of Foreclosed homes. The Fannie Mae Homepath program allows you (the Buyer) to purchase one of their foreclosed homes with only a 3% down payment. Not only that but they will give you 3.5% of the purchase price to use for your closing costs. They have also added extra incentives if you close before December 31st 2010, which is no Mortgage insurance (a big monthly savings) and no appraisal required. This is a great program and should not be easily dismissed.

Overland Park KS - The Stop Foreclosure Institute recently received a question from Arman.
Here is his question. I am a Seller trying to avoid foreclosure. My agent has a buyer and his offer is with the lender from last seven months. Now the lender told us that Fannie Mae investor refused the short sale offer and the house is going to foreclosure early next week.

The lender’s own appraisal shows the house is worth $120K. The offer we have is for $150K. I told the lender that it is unlikely they will receive and offer for 150k after the foreclosure. She replied and said, "We or some of our investors will buy it"!!!
I don't want a foreclose on my record. Is there anything I can do to stop the foreclosure? Thanks a lot for your help. Arman.
Arman gave me a bunch more details. I will relate them here and then tell you what I recommend that he do. He told me the loan is owned by Fannie Mae, and a third party lender is “servicing” the loan for them.
Here was my recommendation to him. I have negotiated lots of short sales. The only reason a lender should turn down a short sale is when their numbers (from an actuarial viewpoint) show that they will reduce their losses with a foreclosure.
That has always been the case on any short sale I have ever negotiated. (Or I should say most of them. Some have been rejected for other reasons, but they are almost always monetary reasons.)
Here is what I would do if I was you.
Step #1: Call up IBM and demand a written letter explaining why they are declining the short sale offer.
Step #2: Write down what you project your damages are going to be if the property is foreclosed upon instead of sold as a short sale.
Step #3: Call up the company handling the loan for Fannie Mae. (Remember, they are not your lender. They are paid by Fannie Mae to do their job in a competent manner.) Tell them if they reject the short sale for no reason and the house is foreclosed, then you will be suing them for those specific damages you drew up in Step #2. I will go into more details about potential damages and the basis for a lawsuit in my next couple of blog posts.

Overland Park KS - The Stop Foreclosure Institute recently received a question from Tim. Here is Tim’s Question.
“I have an elderly friend who recently finalized a loan modification through her lender. The mortgage company shows on their website that the mod has been processed and the new terms are in effect.
However, since foreclosure proceedings were begun before the mod was approved, her homeowner’s insurance holder will not renew her coverage policy, since the local Clerk of Courts records show that the loan is in a foreclosure process.
The mortgage company has not sent the Clerk of Courts notice that the foreclosure case is closed. What can she do to avoid losing her insurance coverage?”

An elderly person almost loses their home to foreclosure and manages to save it at the last minute, only to find out her insurance company wants to kick her to the curb?
Give me a break! That’s pathetic. If I had my insurance with that company, I would fire them immediately!
Here is my suggestion. The first thing your friend should do is to contact the State Insurance Commissioner and the State Attorney General.
Insurance is highly regulated. There are things that insurance companies are allowed to charge more money for and things that they are not allowed to charge more.
I doubt that paying your mortgage late is one of them. More than likely, the insurance company is breaking the insurance regulations of the state.
(This is one of the things we use when negotiating short sales. We have studied to learn all the rules and guidelines. When a lender doesn’t follow a short sale guideline, we will report them to the appropriate agency.)
If that doesn’t work, then I would recommend your friend contact the local media. That is a dastardly thing for the insurance company to do. I’m sure that the general public would agree as well. I think the media would like the story.

Overland Park KS - The Stop Foreclosure Institute recently received a question from James. “My loan was just sold. I was making payments to CitiFinancial and they sold it to Nationstar. Is that good or bad?” James asked.

Here is the answer. It’s neither good nor bad. In fact, I don’t think your loan was sold. You see, most loans were packaged up and sold to Fannie Mae, Freddie Mac, or Wall Street.
James’s loan was more than likely packaged up and sold off. I asked him who his original lender was. He said it was a company called First Magnus. (First Magnus declared bankruptcy in 2007 and was afterwards closed.)
The Stop Foreclosure Institute has negotiated short sales on loans that were originally with First Magnus. The last one was sold to a large Wall Street Firm and securitized.
That means James’s loan could be owned by anyone. More than likely it is owned by Fannie Mae or Freddie Mac. If not, then it was probably sold to a Wall Street Firm.
The owner of the loan hired CitiFinancial to act as their front man. That means Citi collected the payments, handled escrows and accounting, and manages debt collections and foreclosures.
More than likely Nationstar did not buy the loan. Instead whoever owns the loan hired them to act as the front man instead of Citi.

Overland Park KS - I'm sure you have heard about forensic loan audits. I've heard people say how wonderful they are. "Your lender will approve your short sale right away", claims one.

An agent told me a story about forensic loan audits. He worked with a woman who was trying to short sales 3 houses. He knew they were short sales and was glad to list them for sale.
There was a guy involved who was supposed to be doing all the "negotiating" with the lender. Little did this agent know this guy was trying to flip the houses. This guy had a forensic loan audit done.
He claims he paid foreclosure defense lawyers out of his own pocket. He did all this stuff in an attempt to force the lender to approve the short sale.
The only problem was the lender didn't care. The short sale negotiators at the lender were not going to approve the short sale offers so this guy could resell the home for a profit.
"We know this guy is trying to flip the house. We won't approve the short sale as long as he is doing that", they said.
This was despite the claims that some have made that a forensic loan audit will have lenders trip over themselves to approve the short sale.
Please consider this story before you spend $800 to $1,000 on a “Forensic Loan Audit.” I am in the business and talk to homeowners facing foreclosure every day.
I have only heard a few stories where a “forensic loan audit” made a difference to the lender. I’m not saying that they don’t work. I just want to warn you to check them out before spending big bucks for one.

One of the biggest questions every buyer and seller wants to know is, Where's the bottom? Finding the bottom in any real estate is extremely hard to predict. One of the reasons is lag time in data reporting, by the time the media reports that the market has bottomed out it is usually 3 months have past. So we are stuck with trying to predict the bottom.
In the last 3 years we have hit several false flats, where prices stabilize or even rise for a short period of time, only to start to move downward again. What most want to know is when we will truly stabilize for good and even see true appreciation.
When a buyer start to think about buying a home they go through 3 stages. In stage 1 they get curious and start peeking at homes on the internet, driving through some neighborhoods and thinking of when buying may be a possibility?
In Stage 2 that curiosity turns into maybe we should look at a couple of properties. While it is a move towards home ownership, it is a timid one.
It is in Stage 3 where they start to seriously look, get fully qualified for a loan and really get down to researching neighborhoods, school or whatever else is important to their home search. This is when homeownership becomes a reality.
For the last 4 months we have seen a lot buyers in Stage 1, some buyers in Stage 2 but very few in Stage 3. Well that is changing, for the last 2 weeks we have seen more buyers step up to Stage 2 and the former Stage 2 buyers are now Stage 3 buyers.
What does that mean, contract to purchase. Yup, buyers are making offers. Post Election bump? Maybe, but whatever it is my sellers are very happy.
Have you been waiting for a bottom? Well this just might be it. But if it is, you won't hear about it in the media for 3 months and then it may be too late.

Overland Park Real Estate inventory : 126 Overland Park Homes for Sale between $250,000 and $300,000.
Overland Park Real Estate Sales Pace (6 months): 178 Closings in the last 6 months, giving a 6 month average of almost 30 homes selling per month
Overland Park Real Estate Sales Pace (3 months): 58 Closings in the last 3 months, giving a 3 month average of just over 19 homes selling per month
Overland Park Real Estate Sales Pace (1 month): 12 Closings in the last month giving an average of 12 homes selling per month
Month sales pace is dropping. Seasonal and Holiday events, post tax credit hangover, etc. are the most likely causes.

The average person just doesn't realize how "going broke" makes people feel like trash. People start doubting themselves. They keep on kicking themselves down mentally.

All of these people use mean, threatening tactics to try and get them to pay. Then, they get in a fight with their spouse over money. It all adds up. They are emotionally beat.
Sometimes they give up, without even realizing it. It's tough. Everyone kicks you while you are down. They stop taking risks. They stop looking for work.
Or, they lack confidence and as a result don't get the job. Pretty soon they don't think they can contribute to the economy. It is a horrible cycle.
If you are experiencing this, don't give up. Things will turn around. No, I'm not just talking about the general economy. Yes, that will turn around. But, your personal economy will turn around, whether or not the general economy does.
First, you have to get your confidence back. There are several ways you can do this. If you are unemployed, then get a new job. Any job will do, even if it isn't where you want to end up.
If you are overqualified for the job, then you will look awesome there. But, it will make it much easier for you to get a new, better job elsewhere. Someone is much more likely to hire a person who has a job than someone who is unemployed.
Pretty soon you will get your life back together. Yes, it will feel like a long time. It will be humiliating at time. But, if you just keep on pushing, then it will happen.
I have met so many people who have been hurt by this tough economy. All of them have gotten back on their feet eventually. Sure it wasn't fun. But, they did it and I'm sure you can to.

Overland Park KS - Yesterday I gave you a good example of why you should "escalate" a short sale file. The Stop Foreclosure Institute took a short sale that wasn't going to be approved, pushed for an approval, and received it.
As a result a homeowner avoided foreclosure, a buyer was able to buy the home they wanted, the bank reduced their losses, and we made a little money.
There are a few problems you may run into when you attempt to escalate a file. Sometimes the negotiator won't give you their supervisor's info. They won't order a new appraisal or help you out.
Most people would be at a dead end. Here is how to get their supervisor's contact info.

Call the lender's short sale 800 number. Tell the person answering that you are working on a file with the short sale negotiator and you need to talk to their supervisor.
Say something like, "We've talked to the buyers. They will not raise their offer. We've had this house listed for 94 days and this is the best offer we have received. The buyers asked me to call and plead their case."
Most of the time, they will give you the supervisor's name and e-mail address. Always ask for the fax and phone number as well. Most of the time you won't get that, but sometimes you can.
Before we escalated a file, we were scared to do it. What if the negotiator got mad? This held us back, and honestly it hurt everyone
The reality is that the negotiators don't get mad at all. When we are at a logjam with a file, and we have a good case on why they should accept the offer, then we do the logical thing and escalate the file.

Overland Park KS - What do you do when the house won't sell for any more money, but the bank keeps on rejecting the offers? You can give up, but the seller may lose their home to foreclosure.
Ouch! Why not escalate the file and get it approved. Here's an example of how it worked for the Stop Foreclosure Institute. Discover how other sellers successfully did a short sale and request a free consultation by clicking here.
We had a house on the market for 4 months. We started the price at 200k and slowly brought it down to $169,900. We finally got an offer for $159,000. Since I knew the bank's appraiser's valuation, I knew the offer wouldn't work.
The bank's appraiser said the house was worth $195,000. Yes, after we had had the house on the market for 4 months. Because I knew the loan owner's guidelines, I knew that that current offer at $159,000 didn't have a shot at getting accepted.
In order to get this file thru, I had two things to do.
1. Convince the bank that their valuation was inaccurate and that they should order a new value.
2. Escalate the file.
To handle Part 1, I send my own opinion of value, also called a Comparable Market Analysis, along with comparable homes for sale. I explained that the valuation they were using was inaccurate and that they needed to order another one.
Here is what I did for Part 2. Then, I asked for their supervisor's contact info. Remember, most of our communications are e-mail. Two-thirds of the time they will e-mail me back the supervisor's info. The other one-third of the time they will just start doing a better job on the file.
If the new bank appraiser's valuation comes back within range, they will approve the file and we can close. On the subject house, the new appraiser's valuation came back within range. We received an approval on the short sale and it closed a little while later.

Overland Park KS - First, it benefits the owner of the loan. This is because they get to sell the house at today's price, versus what it will be worth 6-12 months down the road. I just did a comparison and pulled up sold listings. All of the listings were the similar properties in similar neighborhoods.
First, I looked up the average selling price per SQFT of homes that sold in Spring. They sold for an average of $103 a SQFT. Then, I pulled up homes in the same neighborhoods that sold as REOs in the last 2 months. They are sold for an average of $85 a SQFT. These homes average 1,700 a SQFT. That means a 1,700 REO sold for $30,600 less. Ouch!

The other person that's getting value is the buyer. They get a better deal in today's market than buying a home from someone who is trying to squeeze out every penny.
You, the seller also benefit. You will be eligible to buy another home in 24 months. You have a better chance of getting a job, because many employers check that nowadays. A short sale is a win - win for everyone involved.

Don't look now but interest rates have risen for 2 straight weeks and are now at a disgustingly high 4.375%. I have absolutely no idea how anyone will be able to afford to purchase a home at these rates. To make matters worse, the average home price has fallen by over 10 percent in the last 2 years.
How in the world will we ever reconcile this. I know personally that I was waiting for 2% interest rates and at least a 30% drop in home prices, that way I could buy back a home that I sold in 1993 for the same price.
Oh well, I will get over it. I really didn't want to buy a house anyway.

Do you remember when you were a kid and you would have contest to see who could hold their breath
the longest? Well when it comes to real estate we seem to play the same game. Buyers are holding their breath in anticipation of sellers drastically lowering their listing prices. Not to be outdone the sellers are holding their breath even longer.
For most buyers they don't have a clear cut time frame to make their purchase, while most would like to

make their move by a specific date. They
are more than willing to hold out if they can reasonably expect that it will net them a serious discount.
Now for the sellers, they just plain and simply don't want to lower their prices. Most are willing to consider a lower offer but they have drawn a line in the sand as far as their listing price goes. They simply have a price range in mind and don't care how long it takes to find absolutely the right buyer.
